China Executes Yang Jia

Concerns are raised over the execution of a jobless man who killed six police officers in Shanghai after a failed bid to complain about being beaten in custody.
HONG KONG—Authorities in Shanghai said Wednesday they had carried out the death sentence handed down to Yang Jia, a man convicted of killing six police officers in the city after attempting to sue police for beating him up.

"In line with an order issued by the Supreme People's Court, the Shanghai No. 2 Intermediate People's Court executed criminal Yang Jia by injection on Nov. 26," the Supreme People's Court said in a statement.

"Before the execution, the parties concerned arranged a meeting between Yang Jia and his mother, Wang Jingmei," the statement added.

I am not in deep sorrow right now. I am determined to find answers to many unanswered questions for Yang Jia."

Yang, 28, an unemployed resident of Beijing, launched an attack on a Shanghai police station on July 1 and began stabbing people, killing six police officers. Another three policemen and one security guard were injured, according to the official version of events.

He was sentenced to death on Sept. 1 in the first verdict by the Shanghai No. 2 Intermediate People's Court. He later appealed. On Oct. 20, the Shanghai Higher People's Court upheld the sentence.

The case has raised questions about police harassment, with some regarding Yang as a victim who stood up to abuse commonly suffered by people on the wrong side of the rich-poor divide in China.

Bid to sue

Yang had tried unsuccessfully to sue police for psychological damage caused by being beaten up while in detention over an unlicensed bicycle.

Yang's mother, who raised Yang as a single parent, was detained and placed in a mental hospital following the murders.

Others criticized the various courts' refusal to look further into assertions by Yang's lawyers that he was mentally unstable.

The case has drawn criticism from lawyers for what they say are too many question marks over due process, and from a public which often complains of police abuses of power.

In a case with which comparisons are already being drawn, two police officers in the northeastern city of Harbin have been arrested over the beating death of a college student in a nightclub, authorities said Wednesday.

The move is apparently aimed at quelling increasing public anger at a force which is frequently accused of corruption and abuse of power.

Due process 'lacking'

Liu Xiaoyuan, a Beijing-based lawyer who has advised Yang's mother on her son's case, said there were many holes in the way the authorities handled it.

"This case has raised concerns throughout the country because there were so many problems with due process," Liu said.

"The fact that they didn't return the case for a second [psychiatric] assessment, but just moved directly to approving his execution is going to mean that people lose any trust in the judicial system," he said.

Observers have also expressed concern over the detention of Yang's mother, Wang Jingmei, shortly after her son's arrest.

Wang was held for four months in a police-run mental hospital before being taken Sunday to visit her son in prison and then escorted to her home in Beijing.

Yang's father, Yang Fusheng, showed signs of strain when interviewed before his son's execution.

"Don't ask me all these questions," he said. "Right now we are in the middle of dealing with it. I'm very worried about his mother's health. She is all alone at home," he said.

"I am not in deep sorrow right now. I am determined to find answers to many unanswered questions for Yang Jia," Yang Fusheng said.

"I still remember Yang Jia’s phrase, 'If you don’t give me an explanation, then I will give you an explanation.' I will finish up what Yang Jia has not finished but I will do it in a non-violent way. I will use the law to fight back against those unlawful people, regardless of their rank."

Social realities

Guizhou-based commentator Zeng Ning said the case had attracted such widespread interest because of the social realities it highlighted.

"The reason ordinary people have taken interest in Yang Jia's case has to do with the reason why he killed those policemen, and with all the different social crises which lie behind his case," Zeng said.

He said many people felt that the real issue in the Yang Jia case was the widespread abuse of police power.

On the eve of Yang's execution, Zeng pointed to the beating to death of the Harbin university student.

"People are bound to asking whether the police officers should also be sentenced to death for killing ordinary people," he said.

"In the absence of any major changes in the factors behind the Yang Jia murder case, the story isn't going to end with the trial or the death sentence handed out to Yang."

Another commentator on social affairs, Ai Momo, suggested that this case could have wide-ranging impact.

"Every step of this case, from the first trial through the appeal, was backward," Ai said. "China’s system is determined to go exactly opposite the wishes of the public. It's a dangerous signal and it may have great impact in Chinese society.

Plaxico Burress shot in right thigh

Super Bowl hero Plaxico Burress was accidentally shot in the right thigh and spent the night in the hospital, another dramatic turn in a tumultuous season in which the star New York Giants receiver has been fined and suspended.

The Giants said the shooting happened Friday night and he was released from the hospital early Saturday. The team did not say where the shooting took place, what hospital Burress went to or how badly he was injured. The Giants called this an “apparent accidental shooting.”

“Our primary concern is for Plaxico’s health and well-being, and given the circumstances, we are relieved to say he was released from a New York City hospital,” the team said in a statement.

Burress was wounded in a nightclub, a team official told The Associated Press. The official spoke on condition of anonymity because the team was still trying to sort out all the facts. ESPN.com reported the shooting was at the Latin Quarter in midtown Manhattan.

The club is a sprawling 15,000-square-foot, two-story restaurant and club located in the Radisson Lexington Hotel. Katia Laine, a manager at the hotel, told the AP police officers had been to the club.

Phone messages and an e-mail left at the nightclub were not immediately returned.

The Giants said they have been in contact with the 31-year-old receiver since the shooting and have discussed the matter with NFL security.

“This incident could become a matter for law enforcement officials, and because of that we have no comment on any of the details,” the team said.

New York City police said they have not spoken to Burress or recovered the gun used in the shooting.

Repeated phones calls to Burress’ home and his agent, Drew Rosenhaus, were not immediately returned.

Added NFL spokesman Joe Browne: “We are gathering information, just like everyone else.”

Burress injured a hamstring two weeks ago against the Baltimore Ravens. The Giants said Friday he would not play Sunday in Washington.

Burress was suspended for a game against Seattle on Oct. 5 and fined $117,500 for missing a team meeting and failing to notify the team of his absence. He said he had a family emergency.

He also was fined $45,000 by the NFL for his conduct during an Oct. 19 game against 49ers in which he abused an official and tossed a ball into the stands.

“Like I said, I am human,” Burress said last month in discussing his runs-ins with the team. “I have made some mistakes. I haven’t made the best of decisions, I am aware of that, and I am the first one to look myself in the mirror, be honest with myself, and say that.”

“But as far as me going out and playing hard, I am going to keep going out and competing,” he added. “Like I said, I just keep going out and doing what is asked of me on the football field, and in whatever that role may be I hope I go out and fulfill it.”

While the team can find it tough handling Burress, he is clearly a playmaker who poses a threat to opponents.

Burress caught the winning pass in the Giants’ Super Bowl win over the New England Patriots, capping a season in which he caught a career-high 12 touchdowns. He was belatedly rewarded, signing a five-year, $35 million contract hours before the season opened in September.

The signing came after an unsettling offseason during which Burress was fined $25,000 for refusing to practice during a mandatory minicamp in June. He also missed most of training camp at the University at Albany with a sprained ankle. He insisted the injury—not his contract—kept him off the field.

Despite a lack of practice, Burress started in the opener against Washington and caught 10 passes for 133 yards. The following week, he had five catches for 81 yards and a touchdown in a win over St. Louis.

The rest of the season has not been as productive. The most passes he has caught in any game since is four in a loss to Cleveland on Oct. 13, the game following his suspension.

Burress has 35 catches for 454 yards and four touchdowns in a season in which he has constantly drawn double coverage. His streak of receptions in 115 consecutive games ended last week in Arizona. He aggravated his hamstring injury during the first series and did not return.

It was the sixth-longest active streak in the league, dating to Nov. 26, 2000 against Cincinnati, Burress’ rookie season in Pittsburgh.

Signed as a free agent in 2005, Burress had caught a pass in all 56 previous games in which he had played for the Giants.

Black Friday Turns Deadly at a New York Wal-Mart

Our thoughts go out to the family of Jdimytai Damour, the Wal-Mart employee who was TRAMPLED TO DEATH by early morning shoppers at a New York Wal-Mart.

The New York Times reports that at about 4:55 am on Friday, a crowd of more than 2,000 who had come out for holiday deals forced their way into the Valley Stream, NY store. The six or so workers manning the front could not hold the unruly crowd back. Witnesses said the doors shattered and 'the shrieking mob surged through in a blind rush for holiday bargains. and Jdimytai Damour was 'thrown back onto the black linoleum tiles and trampled in the stampede that streamed over and around him.'

The detective in charge of the investigation said the store lacked adequate security.

He also went on to call the scene “utter chaos” and said the “crowd was out of control" and that those who ran over the victim could face criminal charges.

“I’ve heard other people call this an accident, but it is not. Certainly it was a foreseeable act,” said the detective.

A witness told the media that shoppers behaved badly even as the store was being cleared AFTER the death, “When they were saying they had to leave, that an employee got killed, people were yelling, ‘I’ve been on line since yesterday morning. They kept shopping.”

Meat intake cut' on cancer fears

One in 10 people has tried to cut down on processed meats such as bacon in the wake of a report linking them to cancer, a survey suggests.

Older people among the 2,124 questioned were most likely to have done this.

A World Cancer Research Fund report last year said those eating two rashers of bacon and two sausages a day faced a 63% higher risk of bowel cancer.

A bowel cancer charity said other factors, including smoking and alcohol, were also key.

The cancer prevention report highlighted the evidence for the potential dangers of processed meat, but also pointed to other elements of diet and lifestyle which could either reduce or increase cancer risk.

A quarter of those questioned in the online survey said they had tried to eat more fruits and vegetables as a result of media coverage of the report, while 18% of people said they were making more effort to watch their weight, after the report described evidence linking excess weight to six forms of cancer.

Heavy consumption of red meat has already been linked to bowel cancer, and 11% of those asked said they had been trying to cut down.

Gut chemicals

However, scientists believe that chemicals created during the curing or processing of meat pose an additional threat to the cells lining the gut.

Among the over-55s, 37% said they had tried to reduce their intake of processed meat.

Younger people were less motivated, with only 6% of them doing this.

Richard Evans, the head of communications for the World Cancer Research Fund, said: "This survey shows that if people are told how they can reduce their risk of cancer then many of them will make changes.

"However, recent market research has shown that despite the wall-to-wall media coverage of our report, many people are still unaware of how things like diet and physical activity affect cancer risk."

The survey also found nearly two in five people were trying to be more physically active, and 9% were trying to cut down on alcohol in response to health messages.

A spokesman for Bowel Cancer UK said: "There is increasing evidence that lifestyle issues such as poor diet, obesity and lack of exercise are directly linked to an increased risk of the disease.

"We recommend that people who eat a diet high in processed meats cut down and eat more fruit and vegetables, but it is also important to remember to not focus on this alone.

"There are many other factors that might contribute to an increased risk of bowel cancer, such as smoking and an excess of alcohol, which should not be ignored."

Huang Guangyu's arrest confirmed

Police have confirmed that one of China's richest men, Huang Guangyu, is being held in custody while they investigate him for "economic crimes".

Mr Huang went missing last week and shares in his company Gome have been suspended from trading.

Officials gave no further details, but Chinese media point to alleged irregularities in the share price of a company controlled by his brother.

The billionaire electrical appliance tycoon is worth some $6bn (£4bn).

"We can confirm for you the news that Wong is being held for investigation by Beijing police in connection with economic crimes," a police spokesman said, referring to Mr Huang by his other name Wong Kwong-yu.

It was the first official confirmation of widespread reports that the founder and chairman of Gome Electrical Appliances Holdings - which sells one in six of the electronic products bought in China - is being questioned for alleged share trading violations or other crimes.

Correspondents say the 39-year-old entrepreneur is something of a legendary figure, a living example of a rise from rags to riches.

The delay in official confirmation of Mr Huang's detention prompted a rare rebuke in a commentary carried on Xinhua, the official news agency.

The agency complained that in the face of many rumours, media questions had gone unanswered, prompting people to feel "lost".

The BBC's Chris Hogg says some in China see the investigation as an indication the authorities need to remind the country's tycoons who is really in charge, despite the former leader Deng Xiaoping's claim that to get rich is glorious.

The company says its operations are not affected by Mr Huang's situation, but has refused further comment.

Drunk driver ends up running over himself

A 21-year-old man was accused of driving drunk and leading police on a chase that finally ended with him running over himself. The man was treated for minor injuries at a Santa Fe hospital and booked in to the Sandoval County detention center on charges of aggravated driving while intoxicated, fleeing a police officer, careless driving and two other outstanding traffic warrants.

A tip to the state's DrunkBuster hot line Sunday afternoon alerted authorities to a possibly drunken driver.

State Police Officer Grace Romero spotted the man's pickup truck swerving across both lanes of a highway, driving slowly and then fast. He refused to stop.

After narrowly missing other vehicles, police said the suspect drove through a ditch and a barbed-wire fence before stopping. He tried to put the truck into park, but it ended up in reverse.

Police said the man fell from his open door and both of his legs were run over by the front driver's side tire.

Online Video Not Killing TV, Says Nielsen

Earlier this month, we heard how online video was cannibalizing TV consumption, thanks to data coming out of an IBM study that polled people across six different countries worldwide. The study showed that 36% of people watched "significantly less" TV as a result of their online video viewing. This week, however, a report from Nielsen contradicts that study. Their "A2/M2 Three Screen Report" released yesterday shows that TV viewership isn't declining at all...in fact, it's at an all time high.



The new report from the media analysts at Nielsen found that video viewing across all three screens - TV, Internet, and mobile - increased from last year. As of the third quarter 2008, the average person in the U.S. watched approximately 142 hours of TV in one month. In addition, people who used the Internet were online 27 hours a month, and people who used a mobile phone spent 3 hours a month watching mobile video.

This year, TV viewing is even breaking records. The average time a U.S. home used a TV set during the 2007-08 television season was up to 8 hours and 18 minutes per day, a record high since Nielsen started measuring television in the 1950's.

Since Nielsen only measures TV viewing in the U.S., that could explain the differences between their findings and those of the IBM study. Or perhaps the IBM study was just a little too subjective. A poll where you ask people to rate their own habits can't compete with the cold, hard data that comes from the Nielsen boxes installed in thousands of homes across the U.S.
TV Execs, Remember: All Three Screens Are Doing Well

We're glad that network TV isn't going away anytime soon, but we're concerned now that this report will give the ever-hesitant TV networks another reason to back away from making their videos available online. If they only hear the part about "TV viewing having a record year," then they're going to miss another very important aspect to this report: viewing has increased on all three screens. That means that even though TV viewing is an all-time high, both mobile viewing and online videos are seeing a surge as well. If anything, that should be a huge encouragement to the industry as it proves that, not only does online and mobile video not detract from TV viewing, there's an opportunity to monetize all three screens for record amounts of income too.

Of course, that's if you believe Nielsen's numbers. IBM said otherwise. (Wait, IBM said? Since when is IBM an expert in TV?) Well, maybe the other counties IBM polled are behaving differently, but here in the U.S. it seems the TV is still king.

Jury convicts mom of lesser charges in online hoax

LOS ANGELES - A Missouri mother on trial in a landmark cyberbullying case was convicted Wednesday of only three minor offenses for her role in a mean-spirited Internet hoax that apparently drove a 13-year-old girl to suicide. The federal jury could not reach a verdict on the main charge against 49-year-old Lori Drew _ conspiracy _ and rejected three other felony counts of accessing computers without authorization to inflict emotional harm.

Instead, the panel found Drew guilty of three misdemeanor offenses of accessing computers without authorization. Each count is punishable by up to a year in prison and a $100,000 fine. Drew could have gotten 20 years if convicted of the four original charges.

U.S. District Judge George Wu declared a mistrial on the conspiracy count. There was no immediate word on whether prosecutors would retry her.

"I don't have any satisfaction in the jury's decision," said Drew's lawyer, Dean Steward. "I don't think these charges should have ever been brought."

Tina Meier, the mother of the dead girl, said Drew deserves the maximum of three years behind bars.

"For me it's never been about vengeance," she said. "This is about justice."

Prosecutors said Drew and two others created a fictitious 16-year-old boy on MySpace and sent flirtatious messages from him to teenage neighbor Megan Meier. The "boy" then dumped Megan in 2006, saying, "The world would be a better place without you." Megan promptly hanged herself with a belt in her bedroom closet.

Prosecutors said Drew wanted to humiliate Megan for saying mean things about Drew's teenage daughter. They said Drew knew Megan suffered from depression and was emotionally fragile.

"Lori Drew decided to humiliate a child," U.S. Attorney Thomas O'Brien, chief federal prosecutor in Los Angeles, told the jury during closing arguments. "The only way she could harm this pretty little girl was with a computer. She chose to use a computer to hurt a little girl, and for four weeks she enjoyed it."

O'Brien, who pronounced the case the nation's first cyberbullying trial, said the jury's decision sent a worthy message: "If you have children who are on the Internet and you are not watching what they are doing, you better be."

Most members of the six-man, six-woman jury left court without speaking to reporters. One juror, who identified himself by his first name only, Marcilo, indicated jurors were not convinced Drew's actions involved the intent alleged by prosecutors.

"Some of the jurors just felt strongly that it wasn't tortious and everybody needed to stay with their feeling. That was really the balancing point," he said.

The case hinged on an unprecedented _ and, some legal experts say, highly questionable _ application of computer-fraud law.

Drew was not directly charged with causing Megan's death. Instead, prosecutors indicted her under the federal Computer Fraud and Abuse Act, which in the past has been used in hacking and trademark theft cases.

Among other things, Drew was charged with conspiring to violate the fine print in MySpace's terms-of-service agreement, which prohibits the use of phony names and harassment of other MySpace members.

"This was a very aggressive, if not misguided, theory," said Matt Levine, a New York-based defense attorney and former federal prosecutor. "Unfortunately, there's not a law that covers every bad thing in the world. It's a bad idea to use laws that have very different purpose."

Drew's lawyer, Steward, contended his client had little to do with the content of the messages and was not at home when the final one was sent. Steward also argued that nobody reads the fine print on service agreements.

Prosecutors said Drew, her then-13-year-old daughter Sarah and Drew's 18-year-old business assistant Ashley Grills set up the phony MySpace profile for a boy named "Josh Evans," posting a photo of a bare-chested boy with tousled brown hair. "Josh" then told Megan she was "sexi" and assured her, "i love you so much."

Grills allegedly sent the final, insulting message to Megan before she killed herself in the St. Louis suburb of Dardenne Prairie, Mo.

Missouri authorities said there was no state law under which Drew could be charged. But federal prosecutors in California claimed jurisdiction because MySpace is based in Beverly Hills.

Sarah Drew testified she never saw her mother use the MySpace account. But Grills, testifying under immunity from prosecution, said she saw Drew type at least one message under the name Josh Evans.

After the suicide, Missouri passed a law against cyber-harassment. Similar federal legislation has been proposed on Capitol Hill.

The trial's outcome was a victory for prosecutors despite the lack of a felony conviction, said Nick Akerman, a New York lawyer who specializes in cases involving the federal computer act.

"What you learned is that the Computer Fraud and Abuse Act is an extremely important tool in the federal arsenal against computer crime," he said.

MySpace said in a statement that it "respects the jury's decision and will continue to work with industry experts to raise awareness of cyberbullying and the harm it can potentially cause."

Medical searches on Web can trigger anxiety

WASHINGTON (AFP) - - Playing doctor on the Web often leads people to mistakenly believe that they are suffering from rare illnesses, according to a study by researchers at Microsoft.


"Web search engines have the potential to escalate medical concerns," or "cyberchondria," Ryen White and Eric Horvitz wrote in the study published by the Redmond, Washington-based software company on Monday.

They described cyberchondria as "unfounded increases in health anxiety based on the review of Web content."

White, an expert in text mining, Web search and navigation, and Horvitz, another Microsoft researcher who is president of the Association for the Advancement of Artificial Intelligence, noted that the Internet provides an "abundant source" of medical information.

"However, the Web has the potential to increase the anxieties of people who have little or no medical training, especially when Web search is employed as a diagnostic procedure," they said.

"Common, likely innocuous symptoms can escalate into the review of content on serious, rare conditions that are linked to the common symptoms," they said.

For example, Web surfers with a headache may determine they have a brain tumor or those with chest pain that they are suffering a heart attack.

"A brain tumor is a concerning possibility when a searcher experiences headache," the researchers said. "However, the probability of a brain tumor given a general complaint of headache is typically quite low."

"Such escalations from common symptoms to serious concerns may lead to unnecessary anxiety, investment of time, and expensive engagements with healthcare professionals," White and Horvitz said.

The researchers said the study was aimed at "improving the search and navigation experience for people turning to the Web to interpret common symptoms" and determining "the challenges that cyberchondria presents for search engine designers."

Microsoft's Live Search engine provided the Web search results for the study and MSN Health and Fitness (health.msn.com) provided medical search results.

The researchers also surveyed the health-related search experiences of 515 individuals.

According to other studies cited by the researchers, eight in 10 American adults have searched for healthcare information online.

Myron Rolle earned Rhodes Sholarship

COLLEGE PARK, Md. - Myron Rolle on Saturday in Birmingham, Ala., earned the Rhodes Scholarship and then boarded a plane to join his Florida State teammates during their important Atlantic Coast Conference game at Maryland.

Rolle, a junior safety at Florida State who wants to pursue a career in medicine, had interviewed for the Rhodes earlier in the day and became one of 31 college students to receive the scholarship – perhaps the most prestigious academic award for international study.

"I feel very fortunate to have been selected as a Rhodes scholar," Rolle said in a statement released by the school. "I've learned so much just by going through the process of application and interviews, and I am a better person for it.

"The interview process requires candidates to evaluate their long-term goals and plans, and it has made me think about how I can make the most impact in terms of service to society."
Rolle graduated in just two and a half years with a 3.75 GPA in exercise science. He wants to study to become a neurosurgeon and practice medicine in impoverished areas, including the Bahamas, which is where his family has roots.

Rolle became the fourth Florida State student to be named a Rhodes Scholar and second FSU athlete. Garrett Johnson, a former standout shot putter at the school, received the scholarship in 2006.

Those who earn the scholarship study for at least two years – with the possibility of a renewal for a third – at the University of Oxford in England. The Rhodes Trust selects two scholars each from 16 regions in the country.

"Florida State University's most treasured values of strength, skill and character live in Myron Rolle," FSU President T.K. Wetherell said in a statement. "He is a remarkable young man and a tremendous example for all of our students."

Rolle's honor comes at a time when Florida State's athletic department needs positive publicity. More than 60 FSU athletes were implicated last year in an academic fraud scandal that resulted in an NCAA investigation and several university-imposed sanctions.

University officials appeared last month before the NCAA Committee on Infractions, which soon will announce what penalties Florida State will endure because of the scandal.

"In the midst of the troubles that have gone on here at Florida State academically, there are still some student-athletes doing the right thing," Rolle said last week. "And if we can continue that trend, possibly we can move that perception from being a school that just focuses on parties or athletics to a school that really fosters and creates strong students and strong individuals in the class room."

After earning perhaps the highest academic honor that can be bestowed on an American college student, Rolle stepped on the field at Byrd Stadium with a little more than six minutes remaining in the second quarter. The fans near the FSU locker room stood and gave him and ovation.

Facebook Sued For Patent Infringement

It's pretty much a rite of passage for any tech company these days, as you get larger and more recognized, some company that has an overly broad and probably obvious patent will sue you for patent infringement. For the company in question, the lawsuit is as much a publicity event as it is an attempt to squeeze revenue from an actual innovator. The latest example of this is with an Ohio company no one's heard of called Leader Technologies, who is suing Facebook for patent infringement, and was kind enough to send out a press release announcing this before Facebook even got to see the lawsuit. Clearly, this is a publicity stunt.

As for the patent itself, it basically describes the rather obvious process of associating a piece of data with multiple categories. It's almost surprising that the company is suing Facebook instead of Google. While I'm not a heavy Facebook user, I'm not sure where Facebook uses such a system. Google, however, has made widespread use of a similar idea with its Gmail "labels." The idea is that rather than sorting data into a specific folder or category, it can be associated with multiple categories. If that seems rather obvious and ridiculously broad, well, that's the patent system for you these days.

Attorney General Mukasey vital signs strong after collapse

WASHINGTON (Reuters) – U.S. Attorney General Michael Mukasey was "conscious, conversant and alert" at a local Washington hospital after collapsing while delivering a national security speech at a hotel, the U.S. Justice Department said late on Thursday.

"His vital statistics are strong and he is in good spirits," department spokesman Peter Carr said in a statement. "The doctors will keep him overnight for further observations."

Mukasey, the top U.S. law enforcement and legal official, was rushed to George Washington University Medical Center in Washington after he collapsed.

President George W. Bush was told of Mukasey's condition and would be kept apprised of any developments, the White House said.

"The president was informed about the attorney general and he has him in his thoughts and hopes that he will have a speedy recovery and be back at work soon," White House spokesman Scott Stanzel said.

One witness said Mukasey, 67, collapsed suddenly and unexpectedly, near the end of his speech defending the Bush administration's war-on-terrorism policies to a conservative legal group.

"It was very somber," said the person, who asked not to be identified, of the atmosphere in the room after Mukasey collapsed.

The individual said Mukasey's security detail quickly moved to handle the situation after his collapse and called for emergency personnel, who then arrived, attended to him and took him to the hospital.

Mukasey, a former federal judge, has been attorney general for about a year, dealing with such issues as terrorism, crime and corporate wrongdoing stemming from the financial crisis. He is expected to leave office in January as part of the changeover to the incoming Obama administration.

His speech was to the annual dinner in Washington of the Federalist Society, held in the grand ballroom at the Marriott Wardman Park Hotel.

Inmate gets $300,000 for lost genitals

Washington state has agreed to pay $300,000 to an ex-prison inmate whose penis was consumed by a flesh-eating bacteria while he was behind bars.
Charlie Manning told The Seattle Times Monday he will have $115,000 left after paying attorney's fees arising from his lawsuit and other bills. He expects to get the money this week.

"It's been a nightmare," Manning said. "I figured I should settle for what I could get because I just want it behind me. It's unreal. It's like something from Mars."

Manning, 61, was serving a 13-month sentence for a drunken fight when he became ill. The prison doctor wrongly diagnosed his symptoms as an allergic reaction to medication. It turned out he had necrotizing fasciitis and the bacteria destroyed his penis and one testicle.

The Department of Corrections said the suit was settled because going to court would have been more expensive.

"While the end result was unfortunate and Mr. Manning's original diagnosis turned out to be inaccurate, this was the result of a misdiagnosis, not the result of poor medical care," officials said in a statement. "Not all medical judgments — whether performed in a prison or at a doctor's office — are infallible."

8-Year-Old's Shocking Murder Confession



In the grainy police interrogation video, the 8-year-old boy sits in a big leather chair as he makes a shocking statement: that he shot his father once, then a second time "so he wouldn't suffer."

The boy – whose name has not been released – was arrested Nov. 5 in St. Johns, Ariz., and charged with premeditated murder. But the newly-released video of his confession has stirred up a controversy. Experts question whether the third grader's statement is legal because he was not read his rights and because no parent or guardian was present at the time.
In the interview, the boy initially tells police he found the body of Tim Romans, 39, a boarder who rented a room at his house, and then ran through the building shouting for his father, Vincent Romero, 29, who was lying dead upstairs.

"There was blood all over his face, I think, and I think I touched it," he tells officers in the video. The boy says he prodded his father's body with his foot "to see if he was a little bit alive" and then sat by the body and cried for half an hour.

Later, as the officers continue to question his story, the boy confesses to shooting both men.

But some experts say the boy's words should not be used against him. "The law enforcement conduct in this case is inexplicable: from interrogating a third-grader without the presence of a parent or other adult to releasing an inflammatory videotape before a trial," legal analyst Jeffrey Toobin told CNN.

While he is currently being held in juvenile jail, the boy will be released for 48 hours starting Nov. 26 to spend Thanksgiving with his mother.

Teen Survives Cougar Attack At Miami Home

A 16-year-old girl was mauled by a cougar — but survived — when a neighbor saved her from the animal's cage at a northwest Miami home.

A Miami-Dade Fire Rescue spokesman says the girl sustained some significant wounds Saturday and she was taken to the hospital with non-life threatening injuries.

Miami-Dade police said 21-year-old Anthony Zitnick, a friend of the girl, illegally entered the wildlife collector's home with the girl and was later arrested. Inside, the 150-pound male cougar, named Chaos, pounced on the girl and clenched his jaws around her head.

Authorities said neighbor Richard Miralles heard screams and wrestled the animal away. Wildlife officials said the owner of the home has legal permits to keep two cougars and several snakes, tortoises and alligators.

Zittnick, 21, is facing charges of burglary into occupied dwelling.

Obama appoints YouTube (Google) as secretary of video

It's great that President-elect Barack Obama is delivering his regularly scheduled Saturday address in both audio and video form. After using the Internet to help him get elected and connect with younger voters, it's clear that his team will continue to exploit the media to deliver its messages and stimulate dialog.

Obama has chosen to upload the video of his Saturday address to Google's YouTube, by far the most dominant video-sharing service, and embed the video on his Change.gov transition site.

The video has already garnered more than 500,000 views, and this is just the beginning of the Obama's administration's use of video. Post-inauguration, there will likely be a White House YouTube channel to push the administration's agenda and to hopefully to provide more transparency.

My question is why favor YouTube? It's obvious that YouTube is the way to reach the most people. According to Nielsen Online's VideoCensus, Google's service served 5.35 billion video streams in September 2008. Yahoo, the closest competitor, had 264 million.

But why should the incoming president, or public official, favor one Internet video service over another? Yahoo, MSN, Blip, Veoh, and other video-sharing sites shouldn't have to lobby the White House for equal time or at least some time. I am sure the choice of YouTube was practical, and has nothing to do with Google CEO Eric Schmidt's very public support of Obama.

Implicit product endorsements are difficult to avoid for any public official. If Obama prefers a BlackBerry, Apple can't do much to fix that problem. But, Obama is rarely seen in pictures with his Blackberry and The New York Times reports that he is going to have to give up his favorite communications device.

In the case of uploading video, the Obama team can create its own branded, video-sharing service neutral video player that allows anyone in the world to embed the content. That might be a more equitable way for Obama to spread his message, and he could still have a YouTube channel.

Eri Yoshida headed to Japan pro league

TOKYO (AFP) — A 16-year-old schoolgirl with a mean knuckleball has been selected as the first woman ever to play alongside the men in Japanese professional baseball.

Eri Yoshida was drafted for a new independent league that will launch in April, drawing attention for a side-armed knuckler that her future manager Yoshihiro Nakata said was a marvel.

"I never dreamed of getting drafted," Yoshida told reporters Monday, a day after she was selected to play for the Kobe 9 Cruise.

"I have only just been picked by the team and have not achieved anything," she said. "I want to play as a pro eventually in a higher league."

Yoshida, 155 centimetres (five feet) tall and weighing 52 kilograms (114 pounds), says she wants to follow in the footsteps of the great Boston Red Sox knuckleballer Tim Wakefield.

A female professional baseball federation existed for a few years in the 1950s, but Yoshida will become Japan's first-ever woman to play alongside professional male players.

Bloodshed at Urban Music Awards

LONDON (AFP) - - Three people were injured in ugly scenes at a British music awards ceremony, with one person seriously hurt, police said Sunday.

Two others sustained minor injuries at the sixth annual Urban Music Awards at the O2 entertainment complex in southeast London on Saturday night. One person has been arrested.

"We were called at 2211 GMT on the 15th to a disturbance at the O2 Arena site," a spokesman for London's Metropolitan Police told AFP.

"We found three men suffering injuries. Two are not serious injuries, the other one is. They appeared to be stab or slash victims. There has been one arrest."

A London Ambulance Service spokesman said the three casualties had been treated at the scene and taken to hospitals.

Police sources indicated that the most serious casualty may have been stabbed and the other two might have been hit by flying glass.

The show was being held in the indigO2, a 2,350-capacity venue inside the O2 former Millennium Dome landmark.

Leona Lewis, Dizzee Rascal, Duffy and Estelle were among the performers nominated for awards.

Soul singer Mica Paris was to be presented with a lifetime achievement award.

Andre Nevling, 24, said a woman sat at the same table as himself was "covered" in blood.

"Obviously the guy who got stabbed must have run straight past her and she's pretty shaken up," he said.

"I saw blood all over the floor and then I was like, 'Jesus you're covered in it'," he said.

Another eyewitness, who wished to remain anonymous, said: "I didn't see what happened but there were champagne bottles flying and I hid under the table."

Natalie Williams, 32, said: "It's a huge shame that a small group of people have ruined everything for everyone."

Secret Service Officer in Sex Sting

A Secret Service sergeant was arrested early Saturday after he allegedly tried to solicit sex from a D.C. police officer working undercover as a prostitute, authorities said.

The sergeant, driving his Secret Service vehicle and in uniform, encountered the undercover officer about 12:50 a.m. near 11th and K streets NW, said Inspector Brian Bray, commander of the District's narcotics and special investigations division.

After bantering about prices and services, Bray said, the woman agreed to perform oral sex for $20 and told the sergeant to meet her around the corner. He was arrested there by D.C. police officers, Bray said.

The sergeant, whose name was withheld by police, was cited for soliciting a prostitute, which carries a maximum 180-day jail sentence, Bray said. He was released.

The Secret Service said the man will be placed on paid administrative leave pending the outcome of the investigation and will also face an internal investigation.

The Wizard of Oz Suicide Legend

The Wizard of Oz is one of the most well known movie classics of all time. Almost everyone has seen it, so of course there are bound to be rumors. One, in particular, is the hanging theory -- the urban legend that either a midget or stagehand hanged themselves on film. The question is, what really happened? While most agree that it is in fact false, some still argue that the hanging was real.

The suicide scene allegedly takes place when Dorothy, the Scarecrow, and the Tin Man head down the yellow brick road, on their way to Emerald City (after the Wicked Witch leaves.) Deep in the background, a dark figure can be seen.

Some say that a distraught munchkin hanged himself. The story says that he was upset because the female munchkin that he loved didn’t feel the same way for him. He then decided to kill himself right on set. Others say that it was a clumsy stagehand who accidentally fell out of a prop tree onto the set, getting caught in a cable of some sort, and was strangled to death.

Legend has it that the figure in the forest clearly takes a wooden block, stands on it, hangs himself, and then kicks the block out from underneath. On the other hand, critics argue that it was an exotic bird which was placed on set to give the movie a natural and realistic atmosphere. The moving figure was simply a bird, most likely a crane, flapping its wings and pecking at the ground.



The rumor started after the movie came out on VHS tape, which enabled people to replay the scene over and over. On the small screen, things appear much differently. With the picture being so small, the image wasn’t clear and this lead people to start the rumors. Supposedly, on the big screen it is undeniably a bird.

If it really was a suicide, why would they keep it on the final movie? Why not just redo the scene? Some conclude that it was “too expensive” and they were short on money. And why wouldn’t someone notice what had happened? After all, the three actors didn’t react to it or even seem to notice what happened.

Whether you believe it or not, it’s up to you. We’ll probably never know what really happened on set. But, there’s no denying it, the moving figure in the trees resembles a man hanging himself.

HPV vaccine prevents genital warts in males"

For the first time, an expensive vaccine aimed at preventing cervical cancer in women has proven successful at preventing a disease in men, according to a study released Thursday by the vaccine's maker.

The disease is genital warts — sexually transmitted, embarrassing and uncomfortable — but not life-threatening.

Still, the results are expected to bolster a likely bid by the vaccine's manufacturer, Merck & Co. Inc., to begin marketing the vaccine to boys, experts said. Merck plans to ask the government for that approval later this year.

"This opens the door to a wonderful opportunity to prevent illness," said Anna Giuliano, a researcher at the H. Lee Moffitt Cancer Center in Tampa, Fla., who worked on the Merck study. The research results were being presented Thursday at a medical conference in Europe.

The focus was Merck's vaccine, Gardasil, which is given in three doses over six months and is priced at about $375.

The vaccine targets the two types of HPV, or human papillomavirus, believed to be responsible for about 70 percent of cervical cancer cases, and two other types that cause most genital warts. HPV is spread through sex.

In 2006, the U.S. government licensed the vaccine for use in girls and women ages 9 to 26. Males can spread the virus, but the vaccine was not licensed for them because there was no evidence it prevented disease in men.

Though about 40 other countries have approved the vaccine for males, there still is no medical proof Gardasil prevents penile cancer or other HPV-associated cancers in men. There also is no evidence it prevents men from spreading HPV to women.

The new study involved about 4,000 males ages 16 to 26 in nearly 20 countries. Results showed the vaccine was 90 percent effective in preventing genital warts, with only 15 cases of persistent infection in the vaccinated group, compared to 101 cases in a group that was given a fake vaccine.

No serious side effects were reported. The research is continuing, but these results reflect how the men were doing about 30 months after the injections, on average.

The results are "very exciting," but it's not clear they will be enough to persuade many American families to get their teenage boys vaccinated, said Dr. Maura Gillison, an HPV researcher at Johns

Hopkins University who was not involved in the Merck study.
She noted that only 1 in 4 girls have gotten the vaccine so far, despite compelling medical studies that indicate the shots prevent female cancers.

"When parents are sitting in a room discussing with a pediatrician whether to vaccinate their child against anything, they'd like to know what the potential benefit is. A parent might say, 'I'm not inclined to vaccinate my child to prevent a benign genital wart,'" she said.

Government officials have been awaiting this interim analysis from Merck. They are eager to see additional information that may come later on the vaccine's effect on precancerous lesions, said Dr. Lauri Markowitz, an HPV expert at the U.S. Centers for Disease Control and Prevention.

"It's obviously encouraging data, but the policy makers will be looking at a variety of different issues," including how cost-effective the shot would be if used in males, said Markowitz, a medical epidemiologist.

HPV causes at least 20,000 cases of cancer in the U.S. each year. Cervical cancer is the most common type, but about a quarter of cancers occur in men, including penile, anal and even head and neck cancers.

Victoria's Secret Bras Could Be Hazardous to Your Health

If you've had an allergic reaction to one of your Victoria's Secret bras, it looks like you're not alone!

A number of ladies from several states have filed complaints against the underwear chain for hawking allegedly flawed bras.

In fact, so many women are coming out with complaints that it looks as if Vicky may have a class action lawsuit on its hands.

That sounds expensive!

An attorney for one of the claimants says formaldehyde is making its way into Victoria's Secret bras which could explain the allergic reactions (i.e. welts and rashes) bra wearers have come down with.

Formaldehyde? Really???

Ohio resident Roberta Ritter said in her complaint, "I had the welts … very red, hot to the touch, extremely inflamed, blistery. It itched profusely. I couldn't sleep, waking up itching. I was just utterly sick."

A number of complaints similar to Roberta's have also popped up on the medical self-help site medhelp.org, according to reports.

Victoria's Secret responded through their PR people with this statement, "We are sorry that a small number of people have had an issue and we want to help them determine the cause… Customer safety and satisfaction are always our primary concerns and we take seriously any issues our customers may have with our products."

In regards to the formaldehyde claim, the bra seller said, "We have strict quality controls around our products, and we do not use formaldehyde in our bras."

Another famous Montecito resident, actor Rob Lowe, called into the show and recounted evacuating his home.

"We got in the car, pulled out of the driveway and the entire mountain behind us was flames, 200 feet high, shooting into the air…This thing came on so fast, you just can't believe it… I'm very lucky. My house is fine. Although I'm looking—I'm talking to you right now and I'm looking out of my office and I can see the smoke billowing still… I've lived out here since 1976 and seen a lot of fires, but last night…I mean, I watched 12, 13 homes burn to the ground. It's so tragic. It's so sad. And this is the worst I have ever seen by far."

In case you were wondering, Oprah's home has, so far, survived the fires. Super O's home is less than a mile from several homes devastated in the blaze and within several hundred yards of the mandatory evacuation zone.

Microsoft combines email and social networking

As web portals like Yahoo and AOL try to open up to the rest of the web by incorporating content from third-party websites, Microsoft has taken a bold step in the same direction by redefining its Windows Live software and websites as a social network.

The software giant re-launched several of its Live websites on Wednesday, combining its popular email and instant messaging services with other web applications.

Just like a standard social network, users can now build their own profile pages, but Microsoft also lets users incorporate content they've made on other websites, including Flickr, LinkedIn, Pandora, Photobucket, Twitter, WordPress and Yelp.

"Our customers have friends across the web," said Chris Jones, VP of Windows Live Experience Program Management in a press release. "They communicate through many unconnected web services and want access to it all from a single location -- without worrying about how it's done."

Windows Live users are automatically logged on to the Windows Live Messenger IM client to communicate with friends. Other services include an online movie making program and a "groups" service that lets users share photos and documents and chat with each other online.

The new Windows Live also includes several elements that come straight from the most popular social networks, including the "what's new feed," a feature very similar to Facebook's newsfeed.

While AOL and Yahoo have both been moving toward a more open and social internet, Microsoft has seemingly passed both of them by. It also puts Microsoft in position to wrestle away advertising dollars from its biggest rival, Google, which also offers email, chat and document sharing services.

Study finds obese kids have arteries like 45-year-olds'

Many overweight children and teenagers could have severe cardiovascular disease in their 20s and 30s, causing a healthcare crisis. Early identification of the problem is a key.

The arteries of many obese children and teenagers are as thick and stiff as those of 45-year-olds, a sign that such children could have severe cardiovascular disease at a much younger age than their parents unless their condition is reversed, researchers said Tuesday.

"It's possible that they will have heart disease in their 20s and 30s," said Dr. Geetha Raghuveer of the University of Missouri at Kansas City, who led the study presented at a New Orleans meeting of the American Heart Assn.

"There's a saying that 'you're as old as your arteries,' meaning that the state of your arteries is more important than your actual age in the evolution of heart disease and stroke," she said. "We found that the state of the arteries of these children is more typical of a 45-year-old than of someone their own age."

Experts did not find the results surprising, but they did view it as "alarming."

"We're facing an epidemic of childhood obesity," said Dr. Michael Schloss, co-director of the lipid treatment program at the New York University School of Medicine, who was not involved in the study. "We are raising a generation of children that are going to have a significant increase in vascular disease as they get older."

A May study from the Centers for Disease Control and Prevention found that 16.3% of U.S. children and teenagers are obese and an additional 15.6% are overweight.

Raghuveer runs a preventive cardiology clinic for children who have high cholesterol levels, obesity and a family history of cardiac deaths. She and her colleagues used ultrasound imaging to measure the thickness of the inner walls of the carotid arteries on 70 children considered at risk.

The carotid arteries supply blood to the brain, and the thickness of their inner walls is routinely used as a surrogate for the condition of the coronary arteries that supply blood to the heart.

The children all had abnormalities in one or more types of cholesterol, and 40 of them had a body mass index, or BMI — a calculation of weight and height routinely used as a measure of obesity — in the 95th percentile.

Because the researchers did not have access to healthy children for comparison, they compared the measured values to readily available data for 45-year-olds, using an arbitrary cutoff value of the 25th percentile, Raghuveer said. They found that three-quarters of the children had artery thickness above this level.

The artery thickening was most advanced in patients who were the most obese and had the highest levels of a type of cholesterol known as triglycerides, so that combination "should be a red flag to the doctor that a child is at high risk of heart disease," she said. Their long-term prospects "are not good" unless they can reverse the condition.

The findings suggest the potential for "a major public health problem" down the road, said Dr. Albert Bove of the Temple University School of Medicine, president-elect of the American College of Cardiology, who was not involved in the study.

"If we begin to see people disabled in their 30s and 40s because of heart disease, we could lose a significant fraction of the workforce," Bove said.

But there is some hope.

"If we can identify the condition early and start modifying triglycerides, we can probably prevent progression and perhaps even promote regression," said Dr. John P. Kennedy, director of prevention cardiology at Marina del Rey Hospital.

Woman Breaks Plastic Surgery World Record to Look Like Barbie

Talk about “plastic” surgery (cue the sitcom laugh track): A 49-year-old British woman (and self-proclaimed “Real Life Barbie”) Sarah Burge has broken the world record for cosmetic procedures (she's had more than 100) in an effort to turn herself into a living doll. Her actions trump the previous record-holder, our own stateside “Barbie” Cindy Jackson, who also says her surgery obsession is spurred by her desire to look like the iconic Mattel toy. (FYI Jackson now seems to make a living through sales of her autobiography and microdermabrasion products, among other things) Now, I’m no doctor but…

I would think that this Barbie-copying business could be a sign of body dysmorphic disorder, where your perception of your physical appearance becomes very distorted. Granted, I could be wrong and these surgery fiends--with their good "I wanted to look just like Barbie-and now I do!" line--could just be incredibly PR-savvy. Either way, what really stumps me is why anyone would want to look like a plastic doll at all--she’s a toy, people! Why you’d tinker with yourself (and spend more than $800,000 as Burge has) to look more like what is essentially an inanimate object is beyond me. (This kind of behavior makes wrinkle-reduction surgery seem tame in comparison!)

The Pregnant Man Is Expecting Again

There was plenty about Barbara Walters's interview with the controversial "pregnant man" Thomas Beatie that "floored her" – but what really got her?

He's pregnant again!

"I looked at him and I said, 'Are you pregnant again?" Walters revealed on The View Thursday when promoting her special What Is a Man, What Is a Woman? Journey of a Pregnant Man. "The baby will be born in June," she confirmed, adding, "I'm speechless."

Beatie is in his first trimester and tells Walters that he did not resume taking testosterone after his daughter Susan's birth so he could have another baby. Beatie's wife, Nancy, is unable to have children because she had a hysterectomy.

The interview with Walters is the couple's first since talking to PEOPLE after Susan's birth in June. It airs Friday night at 10 p.m. ET on ABC.

Did a Bone Marrow Transplant Cure a Cancer Patient of AIDS?

A 42-year-old man who had both leukemia and AIDS received a bone marrow transplant — a common, late-stage treatment for that type of cancer. His doctor selected a bone marrow donor who had a rare genetic mutation that renders people virtually immune to HIV. The transplant appeared to cure the patient of AIDS.

We’re as wary as the next guy of inferring too much from a single case study. Maybe it was a fluke; maybe there were unknown factors at work. But this one is pretty intriguing.

The case was presented at a conference earlier this year (here’s the abstract), and written up in this morning’s WSJ.

As is common for bone marrow transplant recipients, the patient first had radiation and chemotherapy, which tends to kill off many of the immune cells that harbor HIV. After the transplant, the patient’s immune system was repopulated by cells created by the donor marrow.

The donor had a mutation, present in about 1% of Europeans, that creates immune system cells that lack a receptor molecule called CCR5. That receptor plays an important role in HIV’s ability to enter the cell. (Pfizer’s HIV drug Selzentry works by blocking CCR5.)

So the patient’s immune system was repopulated with immune cells that carried the mutation. And, nearly two years after undergoing the transplant, he shows no signs of having any HIV left in his body — despite the fact that he hasn’t taken any AIDS drugs since before the transplant.

Perhaps the most important caveat is just how risky bone marrow transplantation is: It’s given to cancer patients after other treatments fail, and it kills up to 30% of patients.

But researchers hope to apply the apparent lessons of this case to strategies using gene therapy (which carries its own risks) to try to induce the protective mutation in patients with HIV.

David Baltimore, who won a Nobel Prize for research on tumor viruses, has started a company to use gene therapy to target HIV. He calls this case “a very good sign” and a virtual “proof of principle” for gene-therapy approaches.

Too Much Plastic Surgery

Hang Mioku had her first plastic surgery procedure back when she was 28. And, ever since then, the now 48 year-old has been addicted to surgery, having most of them performed on her face.

But, unfortunately for Mioku, having so many operations has left her face disfigured and oddly enlarged.

After a while, her surgeons started to refuse to do any more work on her, and some even suggested she was suffering from some psychological disorder.

Her parents decided to take Mioku to a mental specialist and she started to receive treatment until it became too expensive for her to keep up and she soon went back to getting surgeries.

Somehow she found a doctor who started to give her silicone injections. The idiot even gave her a syringe and silicone to take home so she could self-inject.

However, when her supply of silicone soon ran out, Mioki decided to inject cooking oil into her face!!!

As word spread around about Mioki and her deformed face, they soon featured her on a Korean TV special where several viewers began to pity her and sent in enough donations for Mioki to operate and reduce the size of her face.

During the first procedure alone, surgeons removed 60g of "foreign substance" from her face and 200g from her neck! After several more sessions, her face was greatly reduced but she was left scarred.

And now after all of this, Mioki says she would love to have her original face back.

"Batman" Stupidest Lawsuit EVER

The mayor of a small Turkish city called Batman (real name) is suing…ah, Batman.

Even though the comic book hero was first introduced in 1939, the show debuted in 1966, and the Caped Crusader finally hit the big screen in 1989, (The city of) Batman is only now filing a lawsuit against Christopher Nolan and Warner Bros. for using the name "Batman" without permission. The timing is suspicious considering how Dark Knight - Batman's latest installment - is about to hit the $1 billion mark at box offices worldwide.


The mayor of Batman, Huseyin Kalkan, is also claiming that the shared name has caused several unsolved murder cases and made their women particularly suicidal. He also said that the franchise has made it difficult for businesses of his city to register overseas.

A Warner Bros. rep responded to the lawsuit with "We are only aware of this claim via press reports and have not seen any actual legal action."

Music good for the heart

WASHINGTON (AFP) - - Listening to your favorite music may be helpful to maintaining a healthy heart, according to a study.

The research team at the University of Maryland School of Medicine announced they had shown for the first time the emotions aroused by music enjoyed by the listener to be beneficial to a healthy blood vessel function.

The team, who in a 2005 study noted the cardiovascular benefits of laughter, presented their work at the 2008 Scientific Sessions of the American Heart Association in New Orleans.

"I was impressed with the highly significant differences both before and after listening to joyful music as well as between joyful and anxious music," said head researcher Michael Miller, director of preventive cardiology at the University of Maryland Medical Center and associate professor of medicine at the University of Maryland School of Medicine.

The study found that participants -- 10 healthy, non-smoking volunteers -- listening to music that gave them a sense of joy caused the inner-lining tissues of blood vessels to expand, which increased blood flow.

The response matched the result of the 2005 study of laughter.

To minimize desensitization of emotions felt by listening to their favorite music, participants were instructed to avoid listening to the pieces for a minimum of two weeks before the test.

"The idea here was that when they listened to this music that they really enjoyed, they would get an extra boost of whatever emotion was being generated," said Miller.

The study found that the diameter of the average upper arm blood vessel increased 26 percent after listening to joyful music, and listening to music that caused anxiety narrowed blood vessels by six percent.

The physiological impact of music may also affect the activity of the "feel good" brain chemicals called endorphins, according to the study

The study's results, said Miller, signal yet "another preventive strategy that we may incorporate in our daily lives to promote heart health."

Obama's Sister Says He's 'Not Perfect,' But He's a 'Good Man'

President-elect Barack Obama's half-sister says he isn't perfect – but is the best choice.

Though she couldn't be with him on election night, Maya Soetoro-Ng, 38, shared her feelings about his victory in an e-mail sent to friends last week.

"He may not be a perfect man," she wrote in the message, which she allowed to be shared with her hometown paper, the Honolulu Advertiser. "Certainly, he has often said that he'll likely be an imperfect president, but he is a good man, a smart man, a disciplined soul who balances temperance with determination and courage."

We've made a great choice, I assure you," she wrote.

Just two days before the election, Obama and Soetoro-Ng's grandmother, Madelyn Dunham lost her battle with cancer. (Before her death, Dunham voted for her grandson via absentee ballot.)

"There's a wide swath of emotion cutting through me, sometimes swirling, never simple … a briny mixture of elation, sadness, determination, regret, pride, hope, fatigue," wrote Soetoro-Ng, who cared for Dunham for the past eight years.

Obama and Soetoro-Ng have the same mother, Ann Dunham, who divorced Obama's father, a Kenyan also named Barack Obama, in 1964, and married a second time to Lolo Soetoro, from Indonesia, with whom she had Maya. Obama had invited his half-sister to come to Chicago for the election, but she told friends she wasn't up for it.

"I was too tired to grieve in front of millions," she wrote, "and opted instead to watch the electoral votes accumulate in the [apartment] where Barack spent his high school years with our grandparents."

Giants ace Tim Lincecum wins NL Cy Young Award

NEW YORK – Tim Lincecum was a big winner on a woeful team, which fit him perfectly.

Firing 97 mph fastballs from his miniature frame, the National League Cy Young Award recipient is an anomaly in almost every way.

Lincecum joined Mike McCormick (1967) as the only San Francisco Giants to win the Cy Young, taking home pitching's highest honor by a comfortable margin Tuesday following his second major league season.

"I was definitely surprised. I thought it was going to be a lot closer," Lincecum said.

The slender kid with the whirling windup received 23 of 32 first-place votes and 137 points in balloting by the Baseball Writers' Association of America. Brandon Webb of the Arizona Diamondbacks got four first-place votes and finished second with 73 points.

Listed at 5-foot-11 and 160 pounds, tiny by today's standards for a big league pitcher, Lincecum defied detractors — and the laws of physics — by overpowering one hulking slugger after another.

"I don't remember anybody in my time who had that style of pitching, who put that kind of torque on his body," McCormick said on a Giants conference call. "I think that article in Sports Illustrated that called him a freak probably sums it up."

Lincecum was 18-5 with a 2.62 ERA and a major league-best 265 strikeouts, remarkable numbers for a fourth-place club that finished 72-90.

In fact, Steve Carlton was the lone Cy Young winner to pitch for a team that was worse. The Hall of Famer was an incredible 27-10 with a 1.97 ERA for the 1972 Philadelphia Phillies, who went 59-97.

Lincecum led the NL in winning percentage (.783), ranked second in ERA and was third with 227 innings. The 24-year-old right-hander made his first All-Star squad, but an illness prevented him from appearing in the July 15 game at Yankee Stadium.

"People have been doubting me my whole life," he said. "I don't let them bring me down."

New York Mets ace Johan Santana, who led the league in ERA (2.53) and innings (234 1-3), also garnered four first-place votes and came in third.

The other first-place vote went to Milwaukee lefty CC Sabathia, last year's AL winner who was traded by Cleveland into the National League on July 7. He went 11-2 with a 1.65 ERA and seven complete games in 17 starts for the Brewers, pitching them to their first playoff berth since 1982.

"I definitely thought he was in fair contention," Lincecum said.

Sabathia came in fifth. Brad Lidge, the star closer who had a perfect season for the World Series champion Philadelphia Phillies, was fourth.

Webb, the NL winner in 2006, was runner-up for the second consecutive season after going 22-7 with a 3.30 ERA in 226 2-3 innings.

"In Obama-like fashion, it wasn't close," Giants general manager Brian Sabean said.

The baby-faced Lincecum, nicknamed "Franchise," is certainly an aberration. He eats junk food before starts and doesn't ice his arm. When he was called up from the minors in May 2007, ballpark security workers in San Francisco thought he was a bat boy.

Late this season, some teammates even asked for his autograph — including veteran catcher Bengie Molina.

The Giants held a news conference for Lincecum after he won Tuesday and it drew more media than any club event since Barry Bonds' home run chase in 2007.

"It sent a chill through me a little bit. I got a little choked up," pitching coach Dave Righetti said about hearing the news. "I just spent a week in New York and they didn't even know his name, hardly."

Drafted 10th overall out of Washington in 2006, Lincecum said his major league experience last year helped him succeed this season. He also credited an improved changeup, which he threw more often after finding a comfortable grip.

"I've always taken pride in trying to strike people out," he said. "That's the one (statistic) that kind of gets me fired up."

Lincecum said he was on his couch watching NFL highlights with his roommate when he got the Cy Young call. One of the first people he phoned was San Francisco closer Brian Wilson.

"Me and Tim talked about this a lot. I always pumped him up and said, 'Dude, you know you're going to win the Cy Young?'" Wilson said in a telephone interview. "This was before the season. He had the best fastball, best changeup and best curveball. He pretty much dominated every start. We would set goals and I would say, `I bet you won't strike out 10 and not walk anybody,' and he'd strike out 12. Each game he pitched he kept adding up the tally. Soon, America was going to know he was the best."

McCormick won in the first year the BBWAA honored a pitcher in each league. From 1956-66, only one Cy Young Award was presented for both leagues.

This year's American League winner will be announced Thursday, with Cleveland lefty Cliff Lee a heavy favorite. AL and NL Managers of the Year are Wednesday.

Santana, a two-time AL Cy Young winner with Minnesota, received a $50,000 bonus for finishing third. Sabathia got $75,000 for coming in fifth. Webb's second-place finish increased the buyout of his $8.5 million 2010 club option by $500,000 to $2 million.

Researchers Find A New Old Pyramid

Researchers have discovered some old stuff in Egypt.

Like, some really old stuff.

Egypt's culture minister - Faruq Hosni - announced today, Tuesday, that a 4,300-year-old pyramid had been uncovered at the Saqqara necropolis outside Cairo. The ancient burial place dates back to 2,700 BC and is dominated by the first ever step-pyramid, constructed in honor of King Zoser.

They just discovered a new (old) pyramid????

Though the pyramid now only stands 16 feet, it is believed that when it was constucted, it rose about 50 feet in the air.

That's huge!

And they didn't have cranes or anything!

The base of the pyramid was buired nearly 70 feet underground, where a burial doorway was also found.

Researchers believe the pyramid was constructed for Queen Sesheshet, the mother of King Teti, who founded the 6th Dynasty of Egypt's Old Kingdom.

Amazing!

Its treasures, however, had been looted by tomb raiders.

Woman Killed By Coffin On Her Way To Husband's Funeral!

On Monday, a woman in Brazil died on the way to a cemetery when a traffic accident caused her husband's coffin to fly at her neck.

According to a new report, the woman, 67-year old Marciana Silva Barcelos, was in the front passenger seat of the hearse carrying her husband's coffin.

She died instantly.

Marciana's 76-year-old husband, Josi, died Sunday of a heart attack while dancing at a party.

Looks like Josi didn't want to leave this world alone!

Hopefully, Josi and Marciana are dancing together on a big, fluffy cloud up in the heavens.

No More Google/Yahoo! Partnership

That's right... the highly anticipated union of two of the worlds biggest search engines, Google & Yahoo!, is all over.

Google has pulled the plug on the deal due to continued concerns from the Justice Department on the fairness of the deal and Google's belief that it was a courtroom fight not worth fighting.

Here is what David Drummond; Google Chief Legal Officer had to say about the situation:

...after four months of review, including discussions of various possible changes to the agreement, it's clear that government regulators and some advertisers continue to have concerns about the agreement. Pressing ahead risked not only a protracted legal battle but also damage to relationships with valued partners. That wouldn't have been in the long-term interests of Google or our users, so we have decided to end the agreement.

Not surprisingly, Yahoo! is not happy with the news. Here is an excerpt from the press release they issued regarding the termination:

...Google has terminated the advertising services agreement the companies announced in June. Yahoo! continues to believe in the benefits of the agreement and is disappointed that Google has elected to withdraw from the agreement rather than defend it in court. Google notified Yahoo! of its refusal to move forward with implementation of the agreement following indication from the Department of Justice that it would seek to block it, despite Yahoo!'s proposed revisions to address the DOJ's concerns.

So where does this leave Yahoo!? Will Microsoft come back into the picture with a new takeover offer? Well, I guess we will have to wait to see who makes the next move.

2,000-year-old gold earring found in Jerusalem

JERUSALEM – A luxurious gold, pearl and emerald earring provides a new visual clue about the life of the elite in Jerusalem some 2,000 years ago. And its discovery was a true eureka moment for excavators.

The piece was found beneath a parking lot next to the walls of Jerusalem's Old City. It dates to the Roman period just after the time of Jesus, said Doron Ben-Ami, who directed the dig.

The earring was uncovered in a destroyed Byzantine structure built centuries after the piece was made, showing it was likely passed down through generations, he said.

Archaeologists came upon the earring in a corner while excavating the ruins of the building under a parking lot. "Suddenly one of the excavators came up shouting 'Eureka!'" said Ben-Ami.

The find is eye-catching: A large pearl inlaid in gold with two drop pieces, each with an emerald and pearl set in gold.

"It must have belonged to someone of the elite in Jerusalem," Ben-Ami said. "Such a precious item, it couldn't be one of just ordinary people."

Archaeologist Shimon Gibson, who was not involved in the dig, said the find was truly amazing, less because of its Roman origins than for its precious nature.

"Jewelry is hardly preserved in archaeological context in Jerusalem," he said, because precious metals were often sold or melted down during the many historic takeovers of the city.

"It adds to the visual history of Jerusalem," Gibson added, saying it brings attention to the life of women in antiquity.

Ben-Ami the piece's placement in the destroyed building protected it from looters and kept it preserved. Its location also showed that it must be older than the house itself.

The Israel Antiquities Authority said the earring appeared to have been made using a technique similar to that depicted in portraits from Roman-era Egypt. Experts were able to date the earring by comparing it to similar finds in Europe.

In a statement released Monday, the Antiquities Authority said the earring was "astonishingly well-preserved." Finds from the Roman period are rare in Jerusalem, Ben-Ami said, because the city was destroyed by the Roman Empire in the first century A.D.

Though Gibson dates the piece slightly later than the antiquities authority, to sometime between the second and fourth centuries A.D., he said its quality and beauty were impressive.

And Ben-Ami said he expects more small, luxury items to turn up in future excavations.

Melamine already in global food chain

BEIJING - First, it was baby milk formula. Then, dairy-based products from yogurt to chocolate. Now, chicken eggs have been contaminated with melamine, and an admission by state-run media that the industrial chemical is regularly added to animal feed in China is fueling fears the problem could be more widespread, affecting fish, meat and who knows what else.

Peter Dingle, a toxicity expert at Murdoch University in Perth, Australia, said, however, that aside from the tainted baby formula that killed at least four Chinese infants and left 54,000 children hospitalized just over a month ago, it is unlikely that humans will get sick from melamine.

The amount of the chemical in a few servings of bacon, for instance, would simply be too low, he said.

But Dingle and others said China should have cracked down sooner on feed companies that have boosted their earnings by fortifying their products with the chemical, which is normally used in the manufacture of plastic and fertilizers.

Rich in nitrogen, melamine gives low-quality food and feed artificially high protein readings.

"Traders can make a lot of profit by doing it," said Jason Yan, the U.S. Grains Council's technical director in Beijing.

Extremely high levels of melamine _ as found in the Chinese baby formula _ can cause kidney stones and in extreme cases can bring on life-threatening kidney failure.

But while scientists say it's not dangerous to ingest small amounts, they cannot be definitive because there have been no tests on melamine's effects in humans. Until the contaminated baby formula became public in September, there was never any reason to.

That leaves consumers worldwide, particularly parents, worried about food products from China and even those made elsewhere with ingredients imported from Chinese companies.

Among those not taking any chances is Pranee Suankaew, a homemaker in Bangkok, Thailand.

"Let's go, let's go," the 37-year-old mother said as she tugged her 4-year-old away from the candy aisle where he eagerly eyed a bag of M&Ms. "We're getting you fruit and a lollipop. There's no milk in that."

She said she usually gives in to avoid tantrums. "But this time, I told him, no, no, no."

Experts say melamine sometimes accidentally leaches into the food supply in low levels, from things like plastic dinnerware. It can also seep in from some pesticides and fertilizers.

But in China, it's become clear that the chemical is deliberately added.

The baby formula set off a global recall of foods made with Chinese dairy products and sparked raids in supermarkets across Asia. Twelve truckloads of candy, yogurt and other dairy-based goods were burned in Indonesia's capital, Jakarta, just this week.

In light of state media reports Wednesday on the widespread use of the chemical in animal feed, health experts say the government clearly knew melamine was being added for more than a year, since contaminated dog food made it to markets in North America, but authorities didn't crack down on producers as promised.

With the scandal escalating, Chinese leaders are now desperate to clean up the country's image, making dozens of arrests in recent weeks and firing local and even high-level officials for negligence.

John Chapple, a Singapore-based adviser to Sinoanalytica, a food analysis laboratory in the Chinese city of Qingdao, said the decision to allow state media to report on the years of melamine use seems to show the government is ready to be more active in dealing with food safety.

"However, one is not going to change a hierarchical government system overnight," he added. "It is usually going to be slow to start to react to a crisis, but quick to finally nail it."

Though China has vowed to boost inspections for melamine contamination, it will be difficult to monitor the countless small, illegally operating manufacturers found across the country, other experts said.

"It could take five or even 10 years" before some companies stop adding the chemical to food products, said Yan, of the U.S. Grains Council.

Man Tries To Steal Communion Wafers

During mass, Jonathan Ricci accepted a communion wafer, but he walked away before he took the the communion into his mouth. This got him some unwanted attention from a priest, and in response, Ricci grabbed for a handful of wafers and tried to leave.

After all, the "body of Christ" is oh-so-tasty.

Since Communion is very serious business, pairshoners didn't take Ricci's gluttony too well. While people attempted to detain our Christ-hungry criminal, Ricci became livid, scuffling with his captors, and landing himself in the slammer.

Ricci was slapped with theft (The approximate 15 wafers are valued at $1), battery, and disrupting a religious assembly.

1. Rahm Emanuel was born Nov. 29, 1959, in Chicago, and grew up in the suburb of Wilmette, Ill. He is the second son of Benjamin and Marsha Emanuel.

Dried Mushrooms Slow Climate Warming In Northern Forests

The fight against climate warming has an unexpected ally in mushrooms growing in dry spruce forests covering Alaska, Canada, Scandinavia and other northern regions, a new UC Irvine study finds.

When soil in these forests is warmed, fungi that feed on dead plant material dry out and produce significantly less climate-warming carbon dioxide than fungi in cooler, wetter soil. This came as a surprise to scientists, who expected warmer soil to emit larger amounts of carbon dioxide because extreme cold is believed to slow down the process by which fungi convert soil carbon into carbon dioxide.

Knowing how forests cycle carbon is crucial to accurately predicting global climate warming, which in turn guides public policy to curb greenhouse gas emissions. This is especially important in northern forests, which contain an estimated 30 percent of the Earth's soil carbon, equivalent to the amount of atmospheric carbon.

"We don't get a vicious cycle of warming in dry, boreal forests. Instead, we get the reverse, where warming actually prevents further warming from occurring," said Steven Allison, ecology and evolutionary biology assistant professor and lead author of the study. "The Earth's natural processes could give us some time to implement responsible policies to counteract warming globally."

Soils in the far north contain a lot of carbon from dead grasses, trees and shrubs. Like humans, fungi and bacteria in soil use plant carbon as a food source and convert it into carbon dioxide.

Allison and his colleague, Kathleen Treseder, sought to find out what happens to carbon dioxide levels when boreal forest soil not containing permafrost is warmed. About one-third of the world's boreal forests do not contain permafrost, which is mostly located in Alaska, Canada, Western Siberia and Northern Europe.

Global warming is expected to hit northern latitudes hardest, raising temperatures between 5 and 7 degrees Celsius by the year 2100.

The scientists conducted their experiment in a spruce forest near Fairbanks, Alaska. They built small greenhouses and identified similar unheated plots nearby to serve as controls. Both plots received equal amounts of water.

In mid-May when growing season began, air and soil temperatures were the same in greenhouses and control plots. When greenhouses were closed, air temperature rose about 5 degrees Celsius, and soil temperature rose about 1 degree.

The scientists took measurements in the greenhouses and unheated plots and found that by growing season's end in mid-August, soil in warmed greenhouses produced about half as much carbon dioxide as soil in cooler control plots.

A soil analysis found that about half as much active fungi were present in experimental greenhouse samples compared with samples from the controls. When fungi dry out, they either die or become inactive and stop producing carbon dioxide, the scientists said.

"It's fortuitous for humans that the fungi are negatively affected by this warming," said Treseder, ecology and evolutionary biology associate professor. "It's not so great for the fungi, but might help offset a little bit of the carbon dioxide we are putting directly into the atmosphere by burning fossil fuels."

This study appears online Nov. 3 in the journal Global Change Biology.

Hurricane Paloma weakens as it passes eastern Cuba

HAVANA, Nov. 9 (Xinhua) -- Hurricane Paloma has weakened from a Category 3 storm to a tropical depression while moving across eastern Cuba's Camaguey province, the country's Meterological Institute said Sunday.

Winds of between 10 and 12 kph broke the vertical structure of Paloma in a few hours, causing light rains over the eastern region, the institute said.

The remnants of the hurricane are not likely to generate another storm, it added.

Hurricane Paloma roared over Cuba Saturday night with strong winds exceeding 240 kph.

Local media reported Sunday that the hurricane had caused "considerable damages in Camaguey as well as in the nearby territories of Tunas and Ciego de Avila."

Hundreds of thousands of people had been evacuated before Paloma made landfall in Cuba. No deaths or major injuries have been reported so far.

Paloma was the eighth hurricane of a busy Atlantic hurricane season, which officially ends Nov. 30.

Cuba has been battered by successive hurricanes in recent months, as Gustav and Ike damaged nearly 440,000 homes and forced almost two million people into temporary shelters.

YouTube to Show Full-Length Films by Year End?

The most popular video site on the web, YouTube has long been in negotiations with movie studios to stream full-length feature films. And while there are still a lot of details to be hammered out, sources say that the deal could be complete in thirty to ninety days, according to CNET reports today.

Among the major sticking points, as with everything else on YouTube, is finding the right way to monetize full-length films. According to two studio sources, YouTube parent Google is insistent upon one particular form, though they didn’t say whether that was preroll, postroll or overlays. And of course, there’s still the issue of balancing enough advertising to make it worthwhile to the site and the studio without driving away the viewers.

And here’s something I never thought I’d say: YouTube’s major competition in this area will come from none other than Hulu. Hulu has totally pwned come to dominate the long-form video market online, with high quality streaming. As CNET points out:

A showdown between Hulu and the 3-year-old YouTube was inevitable. Consider that Hulu, the joint video venture formed by NBC Universal and News Corp., attracts only a fraction of the 80 million people who visit YouTube each month, but Hulu still managed to generate nearly the same revenue in its first year in business, according to reports.

Naturally, that strength for YouTube—audience size—is a big reason why the studios have turned to YouTube instead of Hulu.

There is a little bit of precedent for the YouTube deals as well. In July, YouTube announced a partnership with Canadian film company Lionsgate. This partnership yielded film previews from Lionsgate with links to purchase the full-length film for download.

Woman Duct-Taped To Her Seat On Airplane

A flight from Puerto Rico to Chicago had to make a pit stop in North Carolina to drop off a particularly unruly passenger.

Maria Esther Castillo of Oswego, N.Y. was duct-taped to her seat on board the airplane after ankle restraints failed to hold her in place.

Castillo - who is suspected to have had one too many at the airport - slapped a flight attendant's ass and pulled a blind passenger's hair after falling onto the person.

That isn't very nice at all!

When the plane landed, authorities boarded to take Castillo away, but she did not go easily.

Well, we imagine that having duct tape ripped off your skin is not a very pleasant feeling.

Castillo has been charged with resisting arrest and interfering with the operations of a flight crew.

Next time she should cut it off at drink #2.

Airport drinks aren't cheap either!

Washington Approves Of Suicide

While here in California voters decided to "eliminate the right" of gays to marry, in Washington, voters approved the right of terminally ill patients to choose assisted suicide.

On Tuesday, Washington became the second state to approve such a law. Oregon is the first. Similar laws failed in California, Michigan and Maine.

Initiative 1000 allows patients to choose a prescription for self-administered lethal medication. In order to receive the fatal treatment, patients must be at least 18, competent, and a Washington resident, and they must request the medication out loud twice, 15 days apart, in addition to a written request witnessed by two people, one of which cannot be connected to the patient in any way. A doctor must also certify that the patient indeed has less than 6 months to live.

I-1000 met with a wall of opposition during its campaign run, with more than a million dollars poured into it.

In the end, the state approved. The Initiative is intended to provide compassion and dignity to those who are often too ill to care for themselves.

Since Oregon approved of the "Death with Dignity" law in 1994, 340 patients have chosen to end their lives at their own hands. Many were sufferers of cancer who cited "loss of autonomy, loss of dignity and a decreasing ability to participate in activities they enjoyed" as their reasons.

Long-term care worker Mike Dingus voted "Yes," saying, "You don't get much choice coming in, so you should get some choice going out."

Facebook Running Out Of Cash?

Some say Facebook is running out of cash. Good. Maybe now the social network will buckle down and take some of the money Madison Avenue wants to throw its way in order to reach the site's 120 million active users.

This week, for example, Starbucks paid to use a modified version of Facebook's calendar tool to promise US users free coffee if they vote. That kind of "branded experience" is a sign that Facebook might finally be finding ways to use its assets in a way few other sites can.

The problem with Facebook, after all, hasn't been advertiser demand, it's been the site's inability to supply marketers a compelling advertising product.

Since the Beacon fiasco, Facebook has tried to sell brand advertisers on a Google-esque automated ad buying process--in part because investors expect Facebook to eventually turn in Google-esque revenues.

Facebook won't produce these revenues, and it's unlikely that Facebook will be able to automate the sales process. But a top interactive agency exec told me last month that Facebook could make more than a few bucks -- think primetime ad rates -- selling what Madison Avenue likes to call "branded experiences":

Facebook needs to come up with ways for advertisers to be seen as providing new functionality on Facebook itself. By way of analogy, my source told me to imagine American Express sponsoring a normally congested toll road for a day. Drivers approaching the toll booths would see them empty and maybe billboard that read: "No toll today. Drive on through and see what it's like to be an American Express cardholder." Facebook should encourage users to feel like a site improvement was brought to them by a brand. Maybe Facebook's Video application should have been sponsored by Sony's CyberShot line, for example.

Nokia Cuts 600 Jobs, Eyes Emerging Markets

Finnish mobile giant Nokia has announced that it is trimming down its operations by cutting over 600 positions, mainly in marketing and sales departments. The Nokia Research Center (NRC), the business unit that explores and develops technologies that will be available in the marketplace in five to ten years, will also focus on fewer research areas from now on.

In addition to the lay-offs, Nokia is closing an entire company site (Turku) by the end of January 2009, but hopes to relocate all of its 220 employees to Nokia’s site at Salo or in the capital area in Finland. The changes in the Markets unit, Nokia Research Center and in other Nokia functions will come into effect on January 1, 2009.

In another release, Nokia touts the introduction of a range of low-priced mobile devices and new services catered specifically to people in emerging markets (e.g. India). In total, seven new handsets were announced, and the first services Nokia will offer in emerging markets will focus on email (Mail on Ovi), agriculture and education (Nokia Life Tools).

Like many businesses, Nokia is feeling the nasty sting of the economic downturn. Its recently announced Q3 earnings weren’t spectacular either (down over 28 percent on a year earlier), so these lay-offs don’t exactly come unexpectedly. It’s easy enough to find the irony when you look at the two news releases side by side, but I think Nokia is actually making the right strategic move by shifting its focus to custom internet services for countries where there is much room for growth and very specific needs.

Obese Philippine flight attendant grounded after 20 year court fight

MANILA, Oct 31, 2008 (AFP) - An obese flight steward for national flag carrier Philippine Airlines has been grounded for good by the Supreme Court after a 20-year legal battle, court records released Friday said.
In a 28-page ruling, the Supreme Court upheld an earlier decision by a lower court that found merit in the termination of Armanda Yrasuegi's contract.

The 217-pound Yrasuegi was dismissed by Philippine Airlines (PAL) after he failed to lose weight as specified under his contract in 1989.

Yrasuegi challenged the dismissal arguing that his weight had nothing to do with the airworthiness of PAL's airplanes in a legal battle that would stretch for 19 years.

He argued that his being fat was a "sickness and a physical abnormality" that was beyond his control.

But the Supreme Court noted that Yrasuegi repeatedly refused offers of medical assistance to lose weight and ignored weight checks.

It said Yrasuegi ignored suggestions to "trim down."

"Thus, his fluctuating weight indicates absence of willpower rather than an illness," the court said.

"Passenger safety goes to the core of the job of a cabin attendant. On board an aircraft, the body weight and size of a cabin attendant are important factors to consider in case of emergency.

"Aircraft have constricted cabin space, narrow aisles and exit doors," it stressed.

Yrasuegi's ideal weight should have been 166 pounds for his height of five feet, eight inches.

Lewis Hamilton thanks team at McLaren facility in England

Lewis Hamilton thanked McLaren personnel for helping him become Formula One's youngest champion and said he plans to spend the rest of his career with the team.

The 23-year-old Briton drove around the lake at McLaren's technology center in an F1 car and received a big ovation from many of the 1,000 employees at the site.

Hamilton, who has a 75-million-pound ($120 million; 94 million euro), five-year contract with McLaren, said he could never envision driving for anyone else.

"It's easy," he said. "I'm with the team I've always dreamed of being with and if you have the car of your dreams then why would you want to leave? The day I get in the car and don't have the motivation, maybe that's the time to get out but I want to see my career out with this team."

Hamilton returned to Britain after finishing fifth in the Brazilian Grand Prix on Sunday, taking the season title by one point ahead of race winner Felipe Massa of Ferrari.
"We have proved to everyone that we are the best team and we have the best car," said Hamilton, who is also F1's first black champion. "We have been under so much pressure and we have lost together and won together and this weekend we have won the world championship."

He said retaining his title next season would depend on avoiding penalties and mistakes.

"We want to make sure that we come out on top again and, for my part, I want to be even better," he said. "I'm even more determined having had a taste of it."

Hamilton shook hands and posed for pictures with employees amid a shower of confetti. His father, Anthony, and pop singer girlfriend Nicole Scherzinger were also on hand.

"These trophies are a result of all your hard work and you should pat yourselves on the back," he said. "I love this team. I'm not going anywhere."

Hamilton's visit came on the same day he received a congratulatory message from Queen Elizabeth II.

"I'm delighted that you succeeded in winning the Formula One World Championship to become the youngest-ever champion," she wrote. "I send you my warmest congratulations on your remarkable and historic achievement."

F1 chief Bernie Ecclestone, meanwhile, defended Hamilton against critics who accuse him of arrogance.

"Hamilton is a young man doing his best and I get upset with people who say he is ... arrogant ... and all this nonsense," Ecclestone told The Times. "Lewis has achieved an awful lot and it would be bloody difficult for any of us to be the same as him. And yet there are so many people out there that want him to lose so he has to make sure he delivers."

Ecclestone said Hamilton seems to attract the same sort of hostility once reserved for seven-time champion Michael Schumacher.

"I think he comes over as a bit overconfident but don't forget they said the same thing about Michael," he said. "I am sure he will grow into the position he has achieved. It just takes time. He has to be careful what he says and how he presents himself, otherwise there are no fears."

Diet diehards eat less to live longer

PARIS (AFP) - - Inspired by animal experiments showing that underfeeding enhances vitality and prolongs life by 30 percent or more, the US-based Calorie Restriction Society is slashing calorie intake in a bid to beat back the clock and halt the ageing process.
Society member Bob Cavanaugh said: "Some people are doing it strictly to enhance longevity," Cavanaugh said by phone from his home near Moorehead City in North Carolina.

"Others do it to avoid age-related disease, or because they already have diabetes, high cholesterol or clogged arteries and want to clean up their bodies by using diet."

A worldwide epidemic of obesity-related diseases has put a spotlight over the last decade on the link between food and health.

"In rich countries, 90 percent of the population probably eats, on average, about 50 percent too much," noted Christiaan Leeuwenburgh, head of the biology of aeging division at the University of Florida's College of Medicine.

"Even if they were to reduce their calorie intake by half, they would still only be at baseline," the optimal balance between energy input and output, he told AFP.

A wealth of scientific evidence has confirmed that maintaining that balance helps prevent type-2 diabetes, cardiovascular disease and cancer.

But experiments with both animals and humans have also shown that pushing one's calorie intake 10 to 20 percent below that baseline threshold -- without lowering nutrients -- may provide additional health advantages.

Luigi Fontana, a professor in the Division of Geriatrics and Nutritional Science of Washington University in St. Louis, Missouri, has led or co-authored more than a dozen studies on reduced calorie intake in humans.

He is also one of a handful of researchers studying longterm impacts by monitoring a group of nearly 50 adults who have been on calorie restriction diets for at least a decade.

"Most are middle-aged, but they have the cardiovascular profile of a teenager," he said by phone.

Blood pressure, cholesterol, blood sugar and insulin levels are all low while so-called "good" cholesterol remains high, he said. Diabetes and cancer rates are down too.

Studies published earlier this year point to other, specifically age-related, benefits as well.

One shows that cutting calorie intake 20 percent cut damage in DNA and RNA caused by oxidation in half compared to control groups.

Oxidative damage to DNA, proteins and other cellular building blocks accumulate over time and are thought to be a major driver of ageing.

A second study by Fontana, published in July in Aeging Cell, shows that a combination of calorie reduction and limiting protein intake lowers levels of insulin-like growth factor, commonly known as IFG-1.

IFG-1 is a high-risk marker for prostate, breast and colon cancer, and plays a key role in regulating cell growth linked to the ageing process.

Cavanaugh, 61, an ex-marine, started the diet eight years ago after a 15-year history of high cholesterol and blood pressure.

At first he improvised. "I designed a diet I thought was very nutritious, but I had a problem with hunger and would sometimes go on candy binges," he said.

Not until he began to keep track not just of calories but vitamins, minerals and amino acids did the diet really work.

"My level of vitality soared," he said, insisting he has more energy today than 20 years ago.

Consuming less calories does not necessarily mean eating less food, he said. While he only takes in two meals a day, he tucks away large quantities of fruits and vegetables, along with smaller portions of lean meats and fish.

Refined, processed foods high in sugar, fat or salt -- junk food, in other words -- is off the menu.

The average calorie intake for men is about 1,800, and for women between 1,200 and 1,600, depending on height.

Despite the proven health benefits, the jury is still out on whether counting calories enhances longevity, which some scientists think has a genetically-imposed ceiling.

"It may be unlikely that it will extend human lifespan significantly," said Jan Vijg, a scientist at the Buck Institute for Age Research who recently co-authored an overview article on ageing in the London-based journal Nature.

The very fact humans live so long makes it difficult to conduct controlled experiments, he said.

Tests with monkeys underway for two decades give no indication that life in primates can be extended by the 30 or 40 percent seen in rats and mice.

"Will this add 10 years to your life? Nobody knows," said Leeuwenburgh, adding that reducing calories late in life could make it difficult to maintain needed muscle mass.

"But one thing is sure -- calorie restriction will help you reach your maximum lifespan potential, which is different for all of us depending on our genetic profile," he said.

The Calories Restriction Society has about 3,500 dues-paying members, and its website gets about 4,500 hits a day.

Author Michael Crichton dies at age 66

LOS ANGELES (AFP) – Michael Crichton, author of more than a dozen best-sellers including "Jurassic Park" and "The Andromeda Strain," has died of cancer in Los Angeles, aged 66, his website and reports said Wednesday.

An official biography of the author posted on his website said Crichton died Tuesday, but did not give a cause of death.

Crichton died "unexpectedly ... after a courageous and private battle against cancer," according to a statement released by his family, cited by CBS and CNN.

Crichton was the author of numerous blockbusters, some of which sold over 100 million copies, and which were translated in 30 languages worldwide.

He was also the creator of the international hit television hospital drama series "E.R."

Rahm Emanuel sought as White House chief of staff

CHICAGO — President-elect Barack Obama has asked Rep. Rahm Emanuel , D- Ill. , a member of the House of Representatives leadership team and a former Clinton White House adviser, to be his White House chief of staff, aides on Capitol Hill and other Democratic insiders said Wednesday, as Obama quickly began the transition into office.

Neither Emanuel's staff nor Obama's would confirm the offer. Three Democratic insiders who are familiar with the offer — each speaking on the condition that they not be identified because they weren't authorized by the Obama team or by Emanuel to discuss the developments — said that while Emanuel was seriously considering the job, it was their understanding as of late Wednesday afternoon that he hadn't yet accepted it.

Obama's appointments of secretaries of the treasury and defense, national security adviser and other posts are anticipated soon, perhaps by the end of this week, but none was announced Wednesday.

Possible secretary of state picks include Sen. John Kerry , D- Mass. , retiring Sen. Chuck Hagel , R- Neb. , and Democratic New Mexico Gov. Bill Richardson .

At the Pentagon , there's been discussion about Defense Secretary Robert Gates staying on for some months, although it's unclear whether he's willing to do so. Former Navy Secretary Richard Danzig , a top Obama adviser, also has been mentioned for defense chief.

A possible pick for White House national security adviser is James Steinberg , who was President Clinton 's deputy national security adviser.

The day after his historic election, Obama didn't brief reporters, instead huddling privately with advisers and speaking via teleconference to thank his campaign staffers across the country, according to a spokeswoman, Jen Psaki . Those remarks weren't made public.

Obama advisers also formally announced some details of the Obama-Biden Transition Project . It's being organized as a 501(c)(4) group, headquartered in a large government office space in downtown Washington, although Obama is expected to name appointees in Chicago in the coming days and weeks.

The transition is being overseen by three people: John Podesta , a former chief of staff to Clinton and the president of the Center for American Progress , a liberal policy-research center in Washington ; Valerie Jarrett of Chicago , an Obama friend and campaign adviser; and Pete Rouse , Obama's Senate chief of staff. The transition team also announced a 12-member advisory board.

President Bush made a morning statement in the White House Rose Garden congratulating Obama on his victory and pledging that "he can count on complete cooperation from my administration as he makes the transition to the White House ."

As the fourth-ranking Democrat in the Democratic-controlled House, Emanuel was weighing whether to scrap a potential path to the House speakership against service to the country on behalf of the first black president. They both call Chicago home.

A respected political tactician with a reputation for ruthlessness, Emanuel could offer Obama, a relative Washington newcomer, an insider's knowledge of the levers of power. As a highly partisan and often abrasive figure, however, Emanuel also could detract symbolically from Obama's promise to move beyond partisanship and unite Democrats and Republicans.

In addition to advising Clinton, Emanuel, who was first elected to Congress in 2002, previously worked for Illinois Public Action, a consumer rights group; Paul Simon's Senate campaign; Chicago Mayor Richard Daley ; and as the managing director of an investment bank. He led the Democratic Congressional Campaign Committee in 2006, when Democrats gained control of the House.

Forty dead, 10 still missing following Philippine ferry accident

MANILA (AFP) - - The death toll from a ferry accident in the central Philippines rose to 40 Wednesday with 10 people still missing, officials said.

The wooden inter-island ferry overturned Tuesday when it was hit by a freak whirlwind just 20 minutes after leaving port with 119 passengers and crew.

Local police chief Senior Superintendent Ruben Sindac told reporters Wednesday that 40 people drowned, 100 were rescued and 10 still missing indicating that the ferry was overloaded.

The ferry's manifest only listed 119 passengers and crew, said Sindac.

It is a common practice for inter-island ferries to be overloaded with last-minute passengers boarding without being listed in the manifest.

The vessel, described as a large wooden-hulled outrigger, capsized 20 minutes after leaving port when it was hit by a freak gust of wind despite clear weather and calm waters.

The coast guard and local authorities resumed rescue operations at first light, said Sindac, adding that "we have fair weather here so we don't see any obstacle in the search for the missing."

The captain of the vessel, Dante Bumbales, has been found and turned over to coast guard officials investigating the incident, Sindac added.

The ferry had just left the port town of Dimasalang on the northeast coast of Masbate for Sorsogon port 80 kilometers (50 miles) away when the incident occurred.

The accident came four months after the 23,000-tonne "Princess of the Stars" capsized during a typhoon off the central island of Sibuyan carrying 850 passengers and crew.

Only 57 passengers and crew survived the accident, which was the worst maritime disaster in the Philippines for 20 years.

Mishaps involving ferries are common in this archipelago where many poor people rely on small, poorly-maintained vessels to travel between islands.

Obama becomes first black president in America

WASHINGTON – Barack Obama was elected the nation's first black president Tuesday night in a historic triumph that overcame racial barriers as old as America itself.

The son of a black father from Kenya and a white mother from Kansas, the Democratic senator from Illinois sealed his victory by defeating Republican Sen. John McCain in a string of wins in hard-fought battleground states — Ohio, Florida, Virginia and Iowa.

A huge crowd in Grant Park in Chicago erupted in jubilation at the news of Obama's victory. Some wept.

McCain called his former rival to concede defeat — and the end of his own 10-year quest for the White House. "The American people have spoken, and spoken clearly," McCain told disappointed supporters in Arizona.

Obama and his running mate, Sen. Joseph Biden of Delaware, will take their oaths of office as president and vice president on Jan. 20, 2009.

As the 44th president, Obama will move into the Oval Office as leader of a country that is almost certainly in recession, and fighting two long wars, one in Iraq, the other in Afghanistan.

The popular vote was close, but not the count in the Electoral College, where it mattered most.

There, Obama's audacious decision to contest McCain in states that hadn't gone Democratic in years paid rich dividends.

Obama has said his first order of presidential business will be to tackle the economy. He has also pledged to withdraw most U.S. combat troops from Iraq within 16 months.

Fellow Democrats rode his coattails to larger majorities in both houses of Congress. They defeated incumbent Republicans and won open seats by turn.

The 47-year-old Illinois senator was little known just four years ago. A widely praised speech at the Democratic National Convention, delivered when he was merely a candidate for the Senate, changed that.

Overnight he became a sought-after surrogate campaigner, and he had scarcely settled into his Senate seat when he began preparing for his run for the White House.

A survey of voters leaving polling places on Tuesday showed the economy was by far the top Election Day issue. Six in 10 voters said so, and none of the other top issues — energy, Iraq, terrorism and health care — was picked by more than one in 10.

"May God bless whoever wins tonight," President Bush told dinner guests at the White House, where his tenure runs out on Jan. 20.

The Democratic leaders of Congress celebrated in Washington.

"It is not a mandate for a party or ideology but a mandate for change," said Senate Majority leader Harry Reid of Nevada.

Said Speaker Nancy Pelosi of California: "Tonight the American people have called for a new direction. They have called for change in America."

Shortly after 11 p.m. in the East, The Associated Press count showed Obama with 338 electoral vote, well over the 270 needed for victory. McCain had 127 after winning states that comprised the normal Republican base.

The nationwide popular vote was remarkably close. Totals from 58 percent of the nation's precincts showed Obama with 51 percent and McCain with 47.9.

Interviews with voters suggested that almost six in 10 women were backing Obama nationwide, while men leaned his way by a narrow margin. Just over half of whites supported McCain, giving him a slim advantage in a group that Bush carried overwhelmingly in 2004.

The results of the AP survey were based on a preliminary partial sample of nearly 10,000 voters in Election Day polls and in telephone interviews over the past week for early voters.

Democrats also acclaimed Senate successes by former Gov. Mark Warner in Virginia, Rep. Tom Udall in New Mexico and Rep. Mark Udall in Colorado. All won seats left open by Republican retirements.

In New Hampshire, former Gov. Jeanne Shaheen defeated Republican Sen. John Sununu in a rematch of their 2002 race, and Sen. Elizabeth Dole fell to Democrat Kay Hagan in North Carolina.

Democrats also looked for gains in the House. They found their first in Florida, defeating Rep. Tom Feeney, and another in Connecticut, where 22-year veteran Chris Shays was swept away by the Democratic tide.

The resurgent Democrats also elected a governor in one of the nation's traditional bellwether states when Missouri Attorney General Jay Nixon won his race.

Tasmanian Devils Could Be Gone in 20 Years

An Australian zoologist is leading a national project to help save the endangered Tasmanian devil from extinction, a situation that could arise within the next 20 years, experts predict.

Jeremy Austin will lead the project, which has received $168,000 Australian (Australian dollars currently are about two-thirds the value of U.S. dollars) from that nation's government. The research will rely on genetic procedures to examine the impact of an infectious cancer, devil facial tumor disease, on Tasmanian devils.

Tasmanian devils became extinct on the Australian mainland about 400 years ago and are now found only on the Australian island state of Tasmania. Unlike Tasmanian tigers, devils survived initial human impacts following European colonization but in the past decade their numbers have fallen drastically.

"We have lost over half our devils in the past 10 years, with an estimated population of 20,000 to 50,000 mature devils left. Extinction within the next 20 years is a real possibility unless we find a vaccine, eradicate the disease and establish captive colonies," Austin said.

Breeding program

There are 500 disease-free devils in zoos and wildlife parks on the Australian mainland, so scientists recently suggested a breeding program as an "insurance policy" in case a vaccine is not found in time, the British Telegraph newspaper reported.

Some forecasts for the extinction of devils are as low as 10 years, Guy Cooper, conservation society director of Taronga Zoo in Sydney, told the newspaper. The disease is spreading faster than expected.

Austin and colleagues will spend the next three years establishing a conservation program and working to suppress the disease, which is ravaging Australia's largest living marsupial carnivore.

Symptoms of the disease, including cancerous lesions around the mouth, face and neck, were first reported in 1996 at one spot on Tasmania. By 2007, the disease had spread over more than half of the devils' home range there. Some populations have lost up to 89 percent of their members as a result of the facial tumors.

Sex sooner

One way devil populations are coping is by having sex at an earlier age, a study found earlier this year. The fatal disease strikes when devils reach the age of 2, which is about when they become sexually mature enough to breed. So earlier breeding is critical for the survival of the species. Devils only breed two or three times in their lifetime.

The Tasmanian devil is not only a key tourism icon for Australia's most southern State, but also ecologically critical to Tasmania's native ecosystem.

Because Tasmanian devils have extremely low levels of genetic diversity and a chromosomal mutation unique among carnivorous mammals, they are more prone to the infectious cancer. Austin's team will analyze genetic material from devil populations to understand the origin, spread and impact of the disease and try to find a vaccine.

"We need to establish whether the low levels of genetic diversity are due to recent human impacts or a long-term historical pattern," Austin said. "We also need to look at how the cancer is affecting surviving populations and identify individuals that may be resistant to the disease."

Devil facial tumor disease is one of only two known clonally transmissible cancers and appears to have originated from a genetic change of mutation in a single individual. It is spread through biting during fights over food and during mating.

Study links sexual content on TV to teen pregnancy

Sexual content on television is strongly associated with teen pregnancy, a new study from the RAND Corporation shows.

Researchers at the nonprofit organization found that adolescents with a high level of exposure to television shows with sexual content are twice as likely to get pregnant or impregnate someone as those who saw fewer programs of this kind over a period of three years. It is the first study to demonstrate this association, RAND said.

A central message from the study is that there needs to be more dialogue about sex in the media, particularly among parents and their children, said Anita Chandra, the study's lead author and a behavioral scientist at RAND.

"We know that parents are busy, but sitting down and watching shows together with their teen, talking about the character portrayals, talking about what they just witnessed, and really using it as a teachable moment is really, I think, a good recommendation from this research," Chandra said.

To measure exposure, the researchers used a method developed by another research group evaluating 23 shows for sexual content. Then, they asked teenagers how frequently they watched each of those shows, and developed a score based on exposure to the shows.

"We know that if a child is watching more than an hour of TV a day, we know there's a sexual scene in [the] content every 10 minutes, then they're getting a fair amount of sexual content," Chandra said.

Melody Monroe of Norfolk, Virginia, who had her first child when she was 17, said she agrees that sex on television contributes to teen pregnancy. Monroe, who shared some of her views on iReport.com, recalls watching shows on Lifetime Television with her mother that were "almost soft porn," with kissing and bedroom scenes.

"Oh, the guy gets the girl, they fall in love, happily ever after, babies come, I thought that was one way of being loved," said Monroe, now 26. "Happily ever after doesn't happen."

But Sandy Tomlinson of Glendale, Arizona, who had her son at age 15, said she doesn't think television affects teen pregnancy — rather, teen pregnancy has to do with the way parents raise their children.

"I feel that if my parents would have been more involved in my life that I would have made different choices," said Tomlinson, now 27, who also shared her story with iReport.com. "It gets old hearing all these studies that blame everything and everybody but the parents."

The RAND study, published in the November edition of the journal Pediatrics, looked at the results of three surveys of about 2,000 adolescents ages 12 to 17 from 2001 to 2004. It focused on the results from more than 700 participants nationwide who had engaged in sexual intercourse by the third survey.

Researchers asked adolescents about a mix of sitcoms, dramas, animated shows and reality shows known to have sexual content. Chandra declined to name any specific programs, but said sexual content is "pretty pervasive."

While this is one of many factors that influence teen pregnancy, the study is compelling, given that adolescents spend a significant amount of time watching television, Chandra said. The information will help develop prevention programs for kids that focus on media literacy, she said.

Even when accounting for other related factors such as demographics and risk-taking behaviors, the correlation between televised sexual content and teen pregnancy persisted, she said.

The study also found that adolescents living in a two-parent household had a lower probability of pregnancy.

African-Americans, girls, and adolescents with behavioral problems had a higher likelihood of getting pregnant or impregnating someone, as did youths who intend to have children early, the study showed.

A strong association between sexual content on television and teen pregnancy is not surprising, said Dr. Yolanda Wimberly, an assistant professor of clinical pediatrics at the Morehouse School of Medicine and the medical director for the Center for Excellence in Sexual Health. Wimberly, who works in an adolescent clinic, was not involved in the study.

"You cannot expect to have a sexually saturated society with all of your media outlets, but then, at the same time, be surprised when this influences people and their behaviors," she said. "If you're going to do it, then you need to make sure you follow it up with education that people need to make responsible decisions."

It's crucial that parents and guardians talk to their kids about these topics and teach morals and values, but they can do only so much in limiting the amount of sexual content that their teenagers see on television, Wimberly said. Youths will have exposure to these programs outside of the home, such as at friends' houses or on the Internet.

Experts say television shows rarely portray the risks of sex and often don't mention contraception. But previous research from RAND showed that content that includes negative consequences, such as sexually transmitted diseases and unwanted pregnancies, can be educational for teens.

Previous RAND research also showed that teens who watch a lot of television with sexual content are more likely to initiate intercourse the following year.

The National Institutes of Health reported in July that teen pregnancies rose in the United States from 2005 to 2006 for the first time since 1991.

Anthony Badalamenti is a Child Abuser

On Friday, Anthony Badalamenti, a New York trainer featured in the NBC show Biggest Loser, was arrested on charges of beating his live-in girlfriend's 6-year-old son and charged with second-degree assault, possession of a dangerous weapon and endangering the welfare of a child.

He's being held by authorities on a $100,000 bond.

According to reports, the young boy was beaten with weightlifting belts and had multiple lacerations and bruises on his right hand, right leg and buttocks when authorities found him.

The boy has been treated for his injuries and was released to a relative.

The child beater's landlord, who lives below the 'family', was the one who called authorities to intervene.

He told reporters that he heard the child's cries for nearly a month.

He considered it a private matter until he heard the screams again on Friday evening, "The child was pleading for mercy. I said, 'That's it, I can't take it anymore.' "

Sadly, the boy's mother, Jessica Muniz, has also been charged with the same charges as Badalamenti and is being held on $50,000 bond.

The Muniz and Badalamenti families have refused to comment.

So disturbing!

Archaeologist says he found oldest Hebrew writing

HIRBET QEIYAFA, Israel - An Israeli archaeologist has discovered what he believes is the oldest known Hebrew inscription on a 3,000-year-old pottery shard _ a find that suggests Biblical accounts of the ancient Israelite kingdom of David could have been based on written texts.

A teenage volunteer discovered the curved shard bearing five lines of faded characters in July in the ruins of an ancient town on a hilltop south of Jerusalem. Yossi Garfinkel, the Israeli archaeologist leading the excavations at Hirbet Qeiyafa, released his conclusions about the writing Thursday after months of study.

He said the relic is strong evidence that the ancient Israelites were literate and could chronicle events centuries before the Bible was written. This could suggest that some of the Bible's accounts were based on written records as well as oral traditions _ adding credence to arguments that the Biblical account of history is more than myth.

The shard was found near the stairs and stone washtub of an excavated home. It was later discovered to bear characters known as proto-Canaanite, a precursor of the Hebrew alphabet.

The Israelites were not the only ones using the proto-Canaanite characters, and other scholars suggest it is difficult _ perhaps impossible _ to conclude the text is Hebrew. However, Garfinkel based his identification on a three-letter verb from the inscription meaning "to do," a word he said existed only in Hebrew.

"That leads us to believe that this is Hebrew, and that this is the oldest Hebrew inscription that has been found," he said.

Hirbet Qeiyafa sits near the modern Israeli city of Beit Shemesh in the Judean foothills, an area that was once the frontier between the hill-dwelling Israelites and their enemies, the coastal Philistines. The site overlooks the Elah Valley, said to be the scene of the slingshot showdown between David and the Philistine giant Goliath, and near the ruins of Goliath's hometown in the Philistine metropolis of Gath.

Carbon-14 analysis of burnt olive pits found in the same layer of the site as the pottery shard helped archaeologists date it to between 1,000 and 975 B.C., the same time as the Biblical golden age of King David's rule in Jerusalem.

Archaeology has turned up only scant finds from David's time in the early 10th century B.C., leading some scholars to argue the Bible's account of the period inflates the importance of him and his kingdom. Some have even suggested his kingdom may not have existed at all.

But the fortified settlement where the writing was found contains indications that a powerful Israelite kingdom existed near Jerusalem in David's time, says Garfinkel.

If his claim is borne out, it would bolster the case for the Bible's accuracy by indicating the Israelites could record events as they happened, transmitting the history that was recorded in the Old Testament several hundred years later.

Modern Zionism has traditionally seen archaeology as a way of strengthening the Jewish claim to Israel and regarded David's kingdom as the glorious ancestor of the new Jewish state. As a result, finding evidence of his rule has importance beyond its interest to scholars.

The script, which Garfinkel suggests might be part of a letter, predates the next significant Hebrew inscription by between 100 and 200 years. History's best-known Hebrew texts, the Dead Sea scrolls, were penned on parchment beginning 850 years later.

The shard is now kept in a university safe while philologists translate it, a task expected to take months. But several words have already been tentatively identified, including "judge," "slave" and "king." The inscription was shown to other scholars at a peer presentation of the findings.

Some scholars are hesitant to embrace Garfinkel's interpretation, and his findings are already being wielded in the ongoing debate over whether the Bible _ written hundreds of years after many of its events are supposed to have occurred _ is more fact or legend. But the find is certain, at the very least, to prove useful in understanding the development of language and ancient alphabets.

Other prominent Biblical archaeologists warned against jumping to conclusions.

Hebrew University archaeologist Amihai Mazar said the inscription is "very important," but suggested that calling the text Hebrew might be going too far.

"The differentiation between the scripts, and between the languages themselves in that period, remains unclear," he said.

If the inscription is Hebrew, it would connect the Hirbet Qeiyafa settlement to the Israelites and make the text "one of the most important texts, without a doubt, in the corpus of Hebrew inscriptions," said Aren Maier, a Bar Ilan University archaeologist.

While the site is likely to add another "building block" to the historical record, archaeologist Israel Finkelstein of Tel Aviv University said the claims about it went beyond the strict boundaries of science.

Finkelstein, who has not visited the dig but attended a presentation of the findings, warned against what he said was a "revival in the belief that what's written in the Bible is accurate like a newspaper."
